Amending O. Reg. 221/08
(REGISTRATION)
1. Section 9 of Ontario Regulation 221/08 is amended by striking out “shall be revoked” and substituting “may be revoked”.
2. (1) Subsection 11 (1) of the Regulation is amended by striking out “or whose certificate of registration was suspended for failure to pay a fee or penalty required by the by-laws or to provide information required by the by-laws”.
(2) Clause 11 (2) (d) of the Regulation is amended by striking out “or the commencement of the suspension, as the case may be”.
(3) Subsection 11 (3) of the Regulation is amended by striking out “or whose certificate of registration was suspended for failure to pay a fee or penalty required by the by-laws or to provide information required by the by-laws”.
3. The Regulation is amended by adding the following section:
Transition, suspension before August 31, 2015
11.1 If, pursuant to subsection 58 (3) of the Act, a person is not entitled to have a suspension removed under subsection 30 (3) of the Act because the suspension occurred before August 31, 2015, then sections 9 and 11 of this Regulation, as they read immediately before November 27, 2015, continue to apply to the suspension.
Commencement
4. This Regulation comes into force on the day it is filed.
