Amending Reg. 1015 of R.R.O. 1990
(GENERAL)
1. Section 43 of Regulation 1015 of the Revised Regulations of Ontario, 1990 is amended by striking out “Form 62-504F2 in Rule 62-504” and substituting “Form 62-104F2 in National Instrument 62-104”.
2. Section 248 of the Regulation is revoked and the following substituted:
248. In this Part,
“equity security” means a security of an issuer that carries a residual right to participate in the earnings of the issuer and, on liquidation or winding up of the issuer, in its assets.
3. Subsection 252 (2) of the Regulation is amended by striking out “section 100, 100.3 or 100.4 of the Act or an issuer bid that is exempt under section 101.2, 101.4 or 101.5 of the Act” and substituting “section 4.1, 4.4 or 4.5 of National Instrument 62-104 Take-Over Bids and Issuer Bids or an issuer bid that is exempt under section 4.8, 4.10 or 4.11 of National Instrument 62-104 Take-Over Bids and Issuer Bids”.
Commencement
4. This Regulation comes into force on the latest of,
(a) the day section 2 of Schedule 18 to the Budget Measures Act, 2015 comes into force;
(b) the day the rule made by the Ontario Securities Commission entitled “National Instrument 62-104 Take-Over Bids and Issuer Bids” comes into force; and
(c) the day this Regulation is filed.
