Amending O. Reg. 195/15

(GRANTS FOR STUDENT NEEDS - LEGISLATIVE GRANTS FOR THE 2015-2016 SCHOOL BOARD FISCAL YEAR)

1. (1) The English version of subsection 3 (3) of Ontario Regulation 195/15 is amended by striking out “Programs, 2015-16” and substituting “Programs 2015-16”.

(2) Subsection 3 (10) of the Regulation is amended by striking out “dated April 2015” and substituting “revised April 2016”.

2. (1) Paragraph 2 of subsection 12 (1) of the Regulation is amended by striking out “paragraph 4 of section 53” at the end and substituting “section 53”.

(2) Paragraph 5 of subsection 12 (1) of the Regulation is amended by striking out “paragraph 9 of subsection 45 (1)” at the end and substituting “subsection 45 (10)”.

(3) Subsection 12 (1) of the Regulation is amended by adding the following paragraph:

6. Subtract the sick leave credit gratuities amount determined for the board under section 42.1.

3. Subparagraph 1 iii of subsection 15 (1) of the Regulation is amended by striking out “2016” and substituting “2015”.

4. The definition of “School Foundation Allocation Table” in subsection 17 (2) of the Regulation is amended by striking out “dated April 2015” and substituting “revised April 2016”.

5. The English version of paragraph 6 of subsection 23 (5) of the Regulation is amended by striking out “Programs, 2015-16” and substituting “Programs 2015-16”.

6. The Regulation is amended by striking out “First Nations” wherever it appears in the English version of the following provisions and substituting in each case “First Nation”:

1. Clause 32 (1) (c).

2. Subsection 32 (4).

7. Subsection 39 (1) of the Regulation is amended by adding the following paragraphs:

4.1 Add the sick leave credit gratuities amount.

8. Subtract the amount for the earned leave plan, determined as follows:

i. Take the amount set out in Column 2 of Table 12.1 opposite the name of the board.

ii. Add the amount set out in Column 3 of Table 12.1 opposite the name of the board.

9. Add the amount for the one per cent lump sum payment set out in Column 2 of Table 12.2 opposite the name of the board.

8. (1) Subsection 41 (1) of the Regulation is revoked.

(2) Paragraph 1 of subsection 41 (2) of the Regulation is revoked and the following substituted:

1. For each cell in Table 13, determine the number of teachers employed by the board to provide instruction to elementary school pupils who have the qualification category and the number of full years of teaching experience that correspond with the co-ordinates of the cell. For example, a teacher with a qualification category of D and 0.7 years of teaching experience is counted for the purposes of cell D-1 and a teacher with a qualification category of A2 or group 2 and 3.2 years of teaching experience, is counted for the purposes of cell A2/group 2-3.

(3) Paragraphs 6 to 15 of subsection 41 (2) of the Regulation are revoked.

(4) Paragraph 16 of subsection 41 (2) of the Regulation is amended by striking out “paragraph 15” at the end and substituting “paragraph 5”.

(5) Paragraph 1 of subsection 41 (3) of the Regulation is revoked and the following substituted:

1. For each cell in Table 13, determine the number of teachers employed by the board to provide instruction to secondary school pupils who have the qualification category and the number of full years of teaching experience that correspond with the co-ordinates of the cell. For example, a teacher with a qualification category of D and 0.7 years of teaching experience is counted for the purposes of cell D-1 and a teacher with a qualification category of A2 or group 2 and 3.2 years of teaching experience is counted for the purposes of cell A2/group 2-3.

(6) Paragraphs 6 to 15 of subsection 41 (3) of the Regulation are revoked.

(8) Subsection 41 (7) of the Regulation is amended by striking out “actual” wherever it appears.

(9) Subsection 41 (8) of the Regulation is revoked.

(10) Subsection 41 (9) of the Regulation is amended by striking out “actual” in the portion before paragraph 1.

(11) Subsection 41 (10) of the Regulation is revoked.

9. (1) The definitions of “actual number of full years of experience”, “actual qualification category”, “adjusted number of full years of experience” and “adjusted qualification category” in subsection 42 (1) of the Regulation are revoked.

(2) Subparagraph 1 i of subsection 42 (2) of the Regulation is amended by striking out “actual” wherever it appears.

(3) Paragraph 3 of subsection 42 (2) of the Regulation is amended by striking out “actual”.

(4) Paragraphs 8 to 19 of subsection 42 (2) of the Regulation are revoked.

(5) Paragraph 20 of subsection 42 (2) of the Regulation is amended by striking out “paragraph 19” at the end and substituting “paragraph 7”.

(6) Subsection 42 (4) of the Regulation is amended by striking out “actual” wherever it appears.

(7) Subsection 42 (5) of the Regulation is revoked.

(8) Subsection 42 (6) of the Regulation is amended by striking out “actual” in the portion before paragraph 1.

(9) Subsection 42 (7) of the Regulation is revoked.

10. The Regulation is amended by adding the following section:

Sick leave credit gratuities amount

42.1 (1) The sick leave credit gratuities amount for a district school board for the fiscal year is determined by subtracting the amount determined under subsection (3) from the amount determined under subsection (2). If the result is negative, it is deemed to be zero.

(2) Take the total of the following:

1. For each teacher employed by the board who is a member of the Ontario English Catholic Teachers’ Association or the Association des enseignantes et des enseignants franco-ontariens who is eligible to receive a sick leave credit gratuity for the purposes of section 4 of Ontario Regulation 1/13 (Sick Leave Credits and Sick Leave Credit Gratuities) made under the Act and who declares the intention by May 31, 2016 to receive an early gratuity payout,

i. if the teacher is 58 years or older, divide the amount of the teacher’s sick leave credit gratuity by 1.02,

ii. if the teacher is less than 58 years old, divide the amount of the teacher’s sick leave credit gratuity by 1.0787 to the power of (58 minus the teacher’s age in years as of June 30, 2016).

2. For each teacher employed by the board who is a member of the Ontario Secondary School Teachers’ Federation or the Elementary Teachers’ Federation of Ontario who is eligible to receive a sick leave credit gratuity for the purposes of section 4 of Ontario Regulation 1/13 made under the Act and who declares the intention by June 30, 2016 to receive an early gratuity payout,

i. if the teacher is 58 years or older, divide the amount of the teacher’s sick leave credit gratuity by 1.02,

ii. if the teacher is less than 58 years old, divide the amount of the teacher’s sick leave credit gratuity by 1.0787 to the power of (58 minus the teacher’s age in years as of June 30, 2016).

3. For each employee of the board who is a member of the Canadian Union of Public Employees, the Ontario Secondary School Teachers’ Federation – Education Workers, the Elementary Teachers’ Federation of Ontario – Education Workers, the Ontario Council of Education Workers and the Education Workers’ Alliance of Ontario who is eligible to receive a sick leave credit gratuity for the purposes of section 4 of Ontario Regulation 1/13 made under the Act and who declares the intention by June 30, 2016 to receive an early gratuity payout,

i. if the employee is 61 years or older, divide the amount of the employee’s sick leave credit gratuity by 1.02,

ii. if the employee is less than 61 years old, divide the amount of the employee’s sick leave credit gratuity by 1.0787 to the power of (61 minus the employee’s age in years as of June 30, 2016).

4. For each employee of the board, including a principal or vice-principal, who is not in a bargaining unit who is eligible to receive a sick leave credit gratuity for the purposes of section 4 of Ontario Regulation 1/13 made under the Act and who declares the intention by June 30, 2016 to receive an early gratuity payout,

i. if the employee is 59 years or older, divide the amount of the employee’s sick leave credit gratuity by 1.02,

ii. if the employee is less than 59 years old, divide the amount of the employee’s sick leave credit gratuity by 1.0787 to the power of (59 minus the employee’s age in years as of June 30, 2016).

(3) Subtract the amount determined under paragraph 2 of this subsection from the amount determined under paragraph 1 of this subsection. If the result is negative, it is deemed to be zero.

1. The amount, determined as of the last day of the 2015-2016 fiscal year, that would be the amount payable by the board in respect of sick leave credit gratuities for employees of the board had none of the employees of the board declared the intention to receive an early gratuity payout.

2. The amount determined under paragraph 5 of section 6 of Ontario Regulation 488/10 (Determination of Boards’ Surpluses and Deficits) made under the Act. (The amount determined under paragraph 5 of section 6 of Ontario Regulation 488/10 made under the Act is the amount determined by going through the determination process set out in paragraphs 1 through 5 of section 6 of Ontario Regulation 488/10 made under the Act.)

(4) In this section, a reference to the amount of a teacher’s or employee’s sick leave credit gratuity means the amount of the sick leave credit gratuity under subsection 4 (2) of Ontario Regulation 1/13 made under the Act, and the amount payable by the board in respect of sick leave credit gratuities has the corresponding meaning.

11. Paragraph 18 of subsection 44 (1) of the Regulation is revoked and the following substituted:

18. Determine an amount as follows:

i. Total the amounts determined under paragraphs 5, 13 and 17.

ii. In the case of the Ottawa-Carleton District School Board or the Ottawa Catholic District School Board, add the amount determined as follows to the amount determined under subparagraph i:

A. Subtract the amount determined under paragraph 6 from the amount determined under paragraph 9. If the result is negative, it is deemed to be zero.

12. (1) Subsection 45 (1) of the Regulation is amended by striking out “the total of the amounts listed in the following paragraphs” in the portion before paragraph 1 and substituting “determined as follows”.

(2) Paragraph 1 of subsection 45 (1) of the Regulation is amended by adding “Take” at the beginning.

(3) Paragraph 2 of subsection 45 (1) of the Regulation is amended by adding “Add” at the beginning.

(4) Paragraph 3 of subsection 45 (1) of the Regulation is amended by adding “Add” at the beginning and by striking out “paragraph 29” and substituting “paragraph 31”.

(5) Paragraph 4 of subsection 45 (1) of the Regulation is amended by adding “Add” at the beginning and by striking out “paragraph 30” and substituting “paragraph 32”.

(6) Paragraph 5 of subsection 45 (1) of the Regulation is amended by adding “Add” at the beginning and by striking out “paragraph 31” and substituting “paragraph 33”.

(7) Paragraph 6 of subsection 45 (1) of the Regulation is amended by adding “Add” at the beginning.

(8) Paragraph 7 of subsection 45 (1) of the Regulation is amended by adding “Add” at the beginning.

(9) Paragraph 8 of subsection 45 (1) of the Regulation is amended by adding “Add” at the beginning.

(10) Paragraph 9 of subsection 45 (1) of the Regulation is amended by adding “Add” at the beginning.

(11) Subsection 45 (1) of the Regulation is amended by adding the following paragraphs:

10. Add the amount determined under subsection (11) for the board for increasing capital planning capacity.

11. Subtract the amount set out in Column 2 of Table 16.1 opposite the name of the board for the professional learning communities.

(12) The English version of subparagraph 1 ii of subsection 45 (2) of the Regulation is amended by striking out “First Nations” and substituting “First Nation”.

(13) Paragraph 1 of subsection 45 (10) of the Regulation is revoked and the following substituted:

1. If a regulation is in force that sets out the amount the board is required to pay to a trustees’ association for the 2015-2016 school board fiscal year for the activities of the trustees’ association, pursuant to subsection 21 (10) of the School Boards Collective Bargaining Act, 2014, the amount set out in that regulation.

(14) Subsection 45 of the Regulation is amended by adding the following subsection:

(11) The amount for a board for increasing capital planning capacity is determined by taking the total of the amount identified in Column 2 of Table 17.1 opposite the name of the board and the amount identified in Column 3 of Table 17.1, if any, opposite the name of the board.

13. Subparagraph 5 i of subsection 47 (1) of the Regulation is amended by adding the following sub-subparagraph:

M.1 The amount determined under section 57.1.

14. Paragraph 4 of subsection 52 (2) of the Regulation is revoked and the following substituted:

4. The costs are not incurred for purchasing, retrofitting or repairing temporary pupil accommodations.

15. (1) Section 53 of the Regulation is amended by striking out “determined as follows” in the portion before paragraph 1 and substituting “the amount set out in Column 2 of Table 30 opposite the name of the board”.

(2) Paragraphs 1 to 8 of section 53 of the Regulation are revoked.

16. Paragraphs 4 to 7.1 of section 56 of the Regulation are amended by adding “and demolition” after “construction” wherever it appears.

17. (1) Paragraph 4 of section 57 of the Regulation is amended by striking out “construction” and substituting “land purchase and demolition” and by striking out “Table 27.1” and substituting “Table 27.2”.

(2) Paragraph 5 of section 57 of the Regulation is amended by striking out “construction” and substituting “land purchase and demolition” and by striking out “Table 25.2” and substituting “Table 25.3”.

(3) Paragraphs 6 to 7.1 of section 57 of the Regulation are amended by adding “and demolition” after “land purchase” wherever it appears.

18. Subsection 58 (3) of the Regulation is amended by striking out “paragraph 11” and substituting “paragraph 6”.

19. Paragraph 2 of subsection 62 (1) is amended by striking out “paragraph 9 of subsection 45 (1)” at the end and substituting “subsection 45 (10)”.

20. Subparagraph 1 vi of subsection 63 (2) of the Regulation is amended by striking out “subsection 60 (1)” at the end and substituting “subsection 60 (2)”.

21. Paragraph 1 of subsection 64 (3) of the Regulation is amended by striking out “and” at the end of sub-subparagraph i F, by adding “and” at the end of sub-subparagraph ii F and by adding the following subparagraph:

iii. the total of the taxes received by the board in respect of the 2015 calendar year under section 35 of the Assessment Act.

22. (1) Clause 69 (6) (b) of the Regulation is revoked and the following substituted:
