Amending Reg. 941 of R.R.O. 1990

(GENERAL)

1. Subparagraph 4 iv of subsection 32.1 (2) of Regulation 941 of the Revised Regulations of Ontario, 1990 is amended by striking out “members of the class” at the end and substituting “engineering interns”.

2. Clause 41.1 (3) (b) of the Regulation is amended by adding “and” at the end of subclause (i) and by striking out subclauses (ii) and (iii) and substituting the following:

(ii) the applicable fees specified by the by-laws.

3. Section 43 of the Regulation is amended by striking out “the fee prescribed by this Regulation” in the portion before paragraph 1 and substituting “the fee specified by the by-laws”.

4. Paragraph 6 of subsection 46 (1) of the Regulation is amended by striking out “the applicable fees prescribed by this Regulation” at the end and substituting “the applicable fees specified by the by-laws”.

5. (1) Subsection 46.0.1 (6) of the Regulation is revoked.

(2) Clause 46.0.1 (8) (b) of the Regulation is amended by striking out “the fee prescribed by this Regulation” and substituting “the fee specified by the by-laws”.

6. Paragraph 3 of section 47 of the Regulation is revoked and the following substituted:

3. The applicant shall pay the applicable fees specified by the by-laws.

7. Clause 50 (b) of the Regulation is amended by striking out “prescribed by this Regulation” at the end and substituting “specified by the by-laws”.

8. Subsections 51 (1) and (2) of the Regulation are revoked and the following substituted:

(1) The following qualifications and requirements are prescribed for the reinstatement of the licence of a Member who resigned:

1. Payment of the fees owing by the applicant for reinstatement to the Association at the time the applicant resigned, if any, and of the fees specified by the by-laws for the current year.

2. Payment of any reinstatement fee specified by the by-laws.

3. Production of evidence of good character.

9. Subsections 51.1 (1) and (2) of the Regulation are revoked and the following substituted:

(1) The following qualifications and requirements are prescribed for the reinstatement of a licence or limited licence that was cancelled for non-payment of fees:

1. Payment of the fees owing by the applicant for reinstatement to the Association at the time his or her licence or limited licence was cancelled and of the fees specified by the by-laws for the current year.

2. Payment of any reinstatement fee specified by the by-laws.

3. Production of evidence of good character, if the payments referred to in paragraph 1 are made in full more than one year after the cancellation.

4. Successful completion of an assessment by the Experience Requirements Committee that the applicant has sufficient knowledge and understanding of the current laws and standards governing the practice of professional engineering, if the payments referred to in paragraph 1 are made in full more than two years after the cancellation.

10. Section 68 of the Regulation is amended by striking out “the title “consulting engineers”” and substituting “the title “consulting engineer””.

11. Sections 79.1 to 80 and 82 to 87 of the Regulation are revoked.

12. Section 88 of the Regulation is revoked.

Commencement

13. (1) Subject to subsection (2), this Regulation comes into force on the later of the day subsection 5 (15) of Schedule 2 to the Open for Business Act, 2010 comes into force and the day it is filed.

(2) This section and sections 1, 10 and 12 come into force on the day this Regulation is filed.
