Amending O. Reg. 173/16
(COMMUNITY PLANNING PERMITS)
1. Paragraph 3 of section 7 of Ontario Regulation 173/16 is amended by striking out “the Municipal Board” and substituting “the Tribunal”.
2. (1) Clause 9 (1) (b) of the Regulation is revoked and the following substituted:
(b) the day after the day on which all the appeals are disposed of by the Tribunal, or such later date as the Tribunal may otherwise order, subject to subsection (2).
(2) Subsection 9 (2) of the Regulation is amended,
(a) by striking out “the Municipal Board” in the portion before clause (a) and substituting “the Tribunal”; and
(b) by striking out “the Board” in clause (b) and substituting “the Tribunal”.
3. (1) Subsection 10 (6) of the Regulation is amended by striking out “the Municipal Board” in the portion before clause (a) and substituting “the Tribunal”.
(2) Clause 10 (7) (b) of the Regulation is amended by striking out “the Municipal Board” and substituting “the Tribunal”.
(3) Subsection 10 (8) of the Regulation is amended by striking out “the Municipal Board” and substituting “the Tribunal”.
(4) Subsection 10 (15) of the Regulation is revoked and the following substituted:
(15) Subsections 41 (6), (12), (12.0.1), (12.0.2) and (12.1) of the Act and subsections 114 (10), (15), (15.1), (15.2) and (16) of the City of Toronto Act, 2006 do not apply to an application for a community planning permit.
4. Section 11 of the Regulation is amended by striking out “the Municipal Board” and substituting “the Tribunal”.
5. (1) Subsection 12 (1) of the Regulation is amended by striking out “the Municipal Board” and substituting “the Tribunal”.
(2) Subsection 12 (2) of the Regulation is amended by striking out “the Municipal Board” and substituting “the Tribunal”.
(3) Subsection 12 (3) of the Regulation is amended by striking out “by the fee prescribed under the Ontario Municipal Board Act” at the end and substituting “by the fee charged under the Local Planning Appeal Tribunal Act, 2017”.
6. Clause 13 (b) of the Regulation is amended by striking out “the Municipal Board” and substituting “the Tribunal”.
7. (1) Subsection 14 (1) of the Regulation is amended by striking out “the Municipal Board” in the portion before clause (a) and substituting “the Tribunal”.
(2) Subsection 14 (2) of the Regulation is amended by striking out “The Municipal Board’s” at the beginning and substituting “The Tribunal’s”.
(3) Subsection 14 (3) of the Regulation is amended by striking out “the Municipal Board” wherever it appears and substituting in each case “the Tribunal”.
(4) Subsection 14 (4) of the Regulation is amended by striking out “the Municipal Board” and substituting “the Tribunal”.
Commencement
8. This Regulation comes into force on the later of April 3, 2018 and the day it is filed.
