Amending O. Reg. 386/99

(PROVISION OF COMMUNITY SERVICES)

1. Subsection 1 (1) of Ontario Regulation 386/99 is amended by adding the following definition:

“person with complex care needs” means a person who as a result of their condition or circumstances requires,

(a) health services on an intensive and frequent basis, or

(b) health and social services, on an intensive and frequent basis. (“personne aux besoins complexes en matière de soins”)

2. Section 3 of the Regulation is revoked and the following substituted:

3. (1) An approved agency or combination of approved agencies shall not, with respect to any one person at that person’s place of residence, provide or arrange for more than 120 hours of the following services, or a combination of the following services, in any 30-day period:

1. Homemaking services.

2. Personal support services.

(2) Despite subsection (1), if an approved agency that is a local health integration network determines that extraordinary circumstances exist that justify the provision of additional services, the local health integration network may provide more than the maximum number of hours of homemaking and personal support services set out in that subsection,

(a) to a person who is in the last stages of life;

(b) to a person who is awaiting admission to a long-term care home, and who has been placed on a waiting list by a placement co-ordinator under regulations made under the Long-Term Care Homes Act, 2007 and is currently on that list;

(c) to a person with complex care needs; or

(d) for no more than 90 days in any 12-month period, to any other person.

(3) In determining the maximum amount of personal support services that may be provided to a person under this section, an approved agency shall not include any school health personal support services provided under section 7.

3. Clauses 4 (1.1) (a), (b) and (c) of the Regulation are revoked and the following substituted:

(a) to a person who is in the last stages of life;

(b) to a person who is awaiting admission to a long-term care home, and who has been placed on a waiting list by a placement co-ordinator under regulations made under the Long-Term Care Homes Act, 2007 and is currently on that list;

(c) to a person with complex care needs; or

(d) for no more than 30 days in any 12-month period, to any other person.

Commencement

4. This Regulation comes into force on the later of April 1, 2018 and the day it is filed.
