Amending O. Reg. 134/98

(GENERAL)

1. (1) Paragraph 3 of subsection 52 (1) of Ontario Regulation 134/98 is amended by striking out “Child and Family Services Act” and substituting “Child, Youth and Family Services Act, 2017”.

(2) Paragraph 3.1 of subsection 52 (1) of the Regulation is revoked and the following substituted:

3.1 A payment made by a children’s aid society on behalf of a child receiving services under the Child, Youth and Family Services Act, 2017, if the society has determined under clause 32 (1) (b) of Ontario Regulation 156/18 (General Matters Under the Authority of the Minister) made under that Act that there are reasonable and probable grounds to believe that the child is in need of protection and the child has not been placed in the society’s care,

i. by an agreement entered into under subsection 75 (1) of that Act, or

ii. by an order made under clause 94 (2) (d), paragraph 2, 3 or 4 of subsection 101 (1), section 114 or clause 116 (1) (c) of that Act.

(3) Paragraph 3.2 of subsection 52 (1) of the Regulation is amended by striking out “clause 65.2 (1) (b) of the Child and Family Services Act” at the end and substituting “clause 116 (1) (b) of the Child, Youth and Family Services Act, 2017”.

(4) Paragraph 4 of subsection 52 (1) of the Regulation is amended by striking out “clause 175 (f) of the Child and Family Services Act” at the end and substituting “clause 240 (f) of the Child, Youth and Family Services Act, 2017”.

2. Subsection 57 (4.1) of the Regulation is revoked and the following substituted:

(4.1) For the purposes of determining a child’s income, a payment made by a children’s aid society on behalf of a child receiving services under the Child, Youth and Family Services Act, 2017 is exempt, if the society has determined under clause 32 (1) (b) of Ontario Regulation 156/18 (General Matters Under the Authority of the Minister) made under that Act that there are reasonable and probable grounds to believe that the child is in need of protection and the child has not been placed in the society’s care,

(a) by an agreement entered into under subsection 75 (1) of that Act; or

(b) by an order made under clause 94 (2) (d), paragraph 2, 3 or 4 of subsection 101 (1), section 114 or clause 116 (1) (c) of that Act.

Commencement

3. This Regulation comes into force on the later of the day section 350 of Schedule 1 to the Supporting Children, Youth and Families Act, 2017 comes into force and the day this Regulation is filed.
