Amending Reg. 611 of R.R.O. 1990

(SAFETY INSPECTIONS)

1. (1) The definition of “annual inspection certificate” in section 1 of Regulation 611 of the Revised Regulations of Ontario, 1990 is amended by striking out “as modified by sections 1 and 2 of Schedule 3” at the end and substituting “as modified by section 1 of Schedule 3”.

(2) The definition of “annual inspection sticker” in section 1 of the Regulation is amended by striking out “as modified by sections 1 and 2 of Schedule 3” at the end and substituting “as modified by section 1 of Schedule 3”.

(3) The definition of “semi-annual inspection certificate” in section 1 of the Regulation is amended by striking out “as modified by sections 1, 2 and 3 of Schedule 3” at the end and substituting “as modified by sections 1 and 2 of Schedule 3”.

(4) The definition of “semi-annual inspection sticker” in section 1 of the Regulation is amended by striking out “as modified by sections 1, 2 and 3 of Schedule 3” at the end and substituting “as modified by sections 1 and 2 of Schedule 3”.

2. Section 4.1 of the Regulation is amended by striking out “an annual inspection sticker” and substituting “a semi-annual inspection sticker”.

3. Section 4.4 of the Regulation is revoked and the following substituted:

4.4 For purposes of the issuance of a safety standards certificate, the owner or lessee of a commercial motor vehicle that is not required to display an annual inspection sticker under section 8 or the owner or lessee of a school purposes vehicle that is not required to display a semi-annual inspection sticker under section 10 may request that the vehicle be inspected in accordance with the inspection requirements referred to in section 4 or 4.1, as appropriate to the type of vehicle, instead of those referred to in section 3.

4. Clause 8 (4) (b) of the Regulation is amended by striking out “and the vehicle type”.

5. (1) Subsection 10 (5) of the Regulation is revoked and the following substituted:

(5) A bus, a school purposes vehicle and an accessible vehicle shall be inspected in accordance with the inspection requirements set out in NSC Standard 11B as modified by sections 1 and 2 of Schedule 3.

(2) Clauses 10 (6) (a), (b) and (c) of the Regulation are revoked and the following substituted:

(a) complete the semi-annual inspection certificate and semi-annual inspection report and provide copies of them to the owner or lessee;

(b) indicate the month and year of inspection on the semi-annual inspection sticker corresponding to the certificate; and

(c) remove or cover any annual or semi-annual inspection sticker relating to a previous inspection and affix the current semi-annual inspection sticker to the outer surface of the lower right hand corner of the windshield, on a fixed side window as close as practicable to the front of the vehicle or to a conspicuous position on the right side of the vehicle body close to the front of the vehicle.

(3) Subsections 10 (7) and (8) of the Regulation are revoked and the following substituted:

(7) A semi-annual inspection sticker described in subsection (6) is valid until the end of the sixth month after the month of inspection indicated on the sticker.

(8) A bus, school purposes vehicle or accessible vehicle that displays an annual inspection sticker or a combination of annual inspection sticker and semi-annual inspection sticker issued before January 1, 2019, as was required by this section before that date, is deemed to be in compliance with section 85 of the Act.

(4) Subsection 10 (8) of the Regulation, as remade by subsection (3), is revoked.

(5) Subsection 10 (9) of the Regulation is revoked.

(6) Subsection 10 (10) of the Regulation is amended by striking out “also issue an annual inspection certificate and an annual inspection report and affix to the vehicle an annual inspection sticker in the manner described in subsection (6)” at the end and substituting “also issue a semi-annual inspection certificate and a semi-annual inspection report and affix to the vehicle a semi-annual inspection sticker in the manner described in subsection (6)”.

6. (1) Paragraph 1 of subsection 2 (2) of Schedule 3 to the Regulation is revoked and the following substituted:

1. In Section 3: Brake Systems, under A. Options for Inspecting Internal Brake Components of Hydraulic and Air Brake Systems, item 1. Types of Brake Inspections,

i. C. Limited-inspection of drum brake should read as follows:

C.  Limited-inspection of drum brake (this is an inspection through inspection holes and involves no measurement of shoe lining), and

ii. E. Limited-inspection of disc brake should read as follows:

E. Limited-inspection of disc brake (this is an inspection of visually accessible components and involves no measurement of brake pad friction material)

(2) Paragraphs 2 and 3 of subsection 2 (2) of Schedule 3 to the Regulation are revoked.

(3) Section 3 of Schedule 3 to the Regulation is revoked.

Commencement

7. (1) Subject to subsection (2), this Regulation comes into force on the later of January 1, 2019 and the day it is filed.

(2) Subsection 5 (4) comes into force on July 1, 2019.
