Amending O. Reg. 419/15

(DEFINITIONS OF COMMERCIAL MOTOR VEHICLE AND TOW TRUCK)

1. Ontario Regulation 419/15 is amended by adding the following section before the heading “Tow Truck”.

Commercial motor vehicle – restrictions on presence of drugs and alcohol

4.1 For the purposes of sections 48.0.4 and 48.2.2 of the Highway Traffic Act,

“commercial motor vehicle” means,

(a) a motor vehicle of a class described in Column 2 of the Table to subsection 2 (1) of Ontario Regulation 340/94 (Drivers’ Licences) that may be driven only by a holder of a Class A, B, C, D, E or F driver’s licence;

(b) a road building machine; and

(c) a commercial motor vehicle as defined in section 3 of this Regulation.

Commencement

2. This Regulation comes into force on the later of the day section 8 of Schedule 4 to the Cannabis, Smoke-Free Ontario and Road Safety Statute Law Amendment Act, 2017 comes into force and the day it is filed.
