Amending O. Reg. 339/94
(DEMERIT POINT SYSTEM)
1. (1) Section 2 of Ontario Regulation 339/94 is amended by adding “Subject to subsection (2)” at the beginning.
(2) Section 2 of the Regulation is amended by adding the following subsection:
(2) Despite subsection (1), if a person is convicted of an offence under section 78 or 78.1 of the Act that was committed less than five years after a previous conviction under section 78 or 78.1 of the Act, the Registrar shall record six demerit points instead of the number of demerit points that are set out in Column 2 of the Table to this Regulation opposite the offence.
2. Subsection 3 (1) of the Regulation is revoked and the following substituted:
(1) If a person is convicted of an offence or two or more offences arising out of the same circumstances and the penalty imposed by the court includes a period of licence suspension, no demerit points shall be recorded, other than for an offence under section 78 or 78.1 of the Act.
3. (1) Item 7 of the Table to the Regulation is amended by striking out “subsections 144 (7), (8)” in Column 1 and substituting “subsections 144 (8)”.
(2) The Table to the Regulation is amended by adding the following item:

(3) Item 21 of the Table to the Regulation is amended by striking out “3” in Column 2 and substituting “4”.
(4) Item 41 of the Table to the Regulation is amended by striking out “3” in Column 2 and substituting “4”.
Commencement
4. (1) Subject to subsection (2), this Regulation comes into force on the later of September 1, 2018 and the day it is filed.
(2) Section 1 comes into force on the later of January 1, 2019 and the day this Regulation is filed.
