Amending O. Reg. 166/11

(GENERAL)

1. (1) Subclause 5 (3) (b) (i) of Ontario Regulation 166/11 is amended by striking out “or any applicable federal law related to cannabis” and substituting “or the Cannabis Act (Canada)”.

(2) Subclause 5 (3) (b) (ii) of the Regulation is amended by striking out “or any applicable federal law related to cannabis, including a peace bond, probation order, prohibition order or warrant” at the end and substituting “or the Cannabis Act (Canada), including a peace bond, probation order, prohibition order or warrant to arrest, and”.

(3) Subclause 5 (3) (b) (iii) of the Regulation is revoked.

(4) Subclause 5 (3) (b) (iv) of the Regulation is amended by striking out “or any applicable federal law related to cannabis” at the end and substituting “or the Cannabis Act (Canada)”.

2. (1) Subsection 13 (1) of the Regulation is amended by striking out “police background check” in the portion before clause (a) and substituting “police record check”.

(2) Clause 13 (1) (a) of the Regulation is revoked and the following substituted:

(a) conducted by a police record check provider within the meaning of the Police Record Checks Reform Act, 2015; and

(3) Subsection 13 (2) of the Regulation is amended by striking out “The police background check shall include a vulnerable sector screen” at the beginning and substituting “The police record check must be a vulnerable sector check mentioned in paragraph 3 of subsection 8 (1) of the Police Record Checks Reform Act, 2015”.

(4) Subsection 13 (3) of the Regulation is amended by striking out the portion before paragraph 1 and substituting the following:

(3) Subject to section 1 of the Schedule to the Police Record Checks Reform Act, 2015 with respect to a police record check set out in Column 4 of the Table to section 1 of that Schedule, a licensee of a retirement home shall require that a staff member or volunteer who applies to work or who works in the home provide the licensee with a signed declaration disclosing the following with respect to the period since the day the person’s last police record check was conducted under subsection (1) of this section or, if no such police record check has been conducted, since July 1, 2012:

(5) Paragraph 1 of subsection 13 (3) of the Regulation is amended by striking out “or any applicable federal law related to cannabis” and substituting “or the Cannabis Act (Canada)”.

(6) Paragraph 2 of subsection 13 (3) of the Regulation is amended by striking out “or any applicable federal law related to cannabis, including a peace bond, probation order, prohibition order or warrant” at the end and substituting “or the Cannabis Act (Canada), including a peace bond, probation order, prohibition order or warrant to arrest”.

(7) Paragraph 3 of subsection 13 (3) of the Regulation is revoked.

(8) Paragraph 4 of subsection 13 (3) of the Regulation is amended by striking out “or any applicable federal law related to cannabis” at the end and substituting “or the Cannabis Act (Canada)”.

3. Clause 15 (3) (f) of the Regulation is amended by striking out “the appropriate police force” and substituting “the appropriate police service”.

4. The definition of “hazardous substance” in subsection 21 (1) of the Regulation is amended by striking out “controlled product” and substituting “hazardous product”.

5. The following provisions of the Regulation are amended by striking out “police background checks” wherever that expression appears and substituting in each case “police record checks”:

1. Clause 55 (5) (a).

2. Subsection 56 (6).

Commencement

6. (1) Subject to subsections (2) and (3), this Regulation comes into force on the day it is filed.

(2) Subsections 2 (1), (2), (3) and (4) and section 5 come into force on the later of November 1, 2018 and the day this Regulation is filed.

(3) Section 3 comes into force on the later of the day section 212 of Schedule 1 to the Safer Ontario Act, 2018 comes into force and the day this Regulation is filed.
