2. (1) Subsection 56 (1) of the Regulation is amended by adding the following paragraphs:

5.1 Take the total of the costs described in subsection (2.1) that have not been accounted for in paragraph 5 of this subsection that relate to any of the following major group elements:

i. Substructure.

ii. Shell.

iii. Services.

5.2 Take the lesser of the amount determined under paragraph 5.1 and the amount specified for the board in Column 4 of the Table to subsection 56 (1) of the 2017-2018 grant regulation.

5.3 Take the total of the amounts determined under paragraphs 5 and 5.2.

(2) Paragraph 8 of subsection 56 (1) of the Regulation is amended by striking out “paragraph 5” wherever it appears and substituting in each case “paragraph 5.3”.

(3) Paragraph 11 of subsection 56 (1) of the Regulation is amended by striking out “Column 3 of the Table to this subsection” at the end and substituting “Column 3 of the Table to subsection 56 (1) of the 2017-2018 grant regulation”.

(4) Section 56 of the Regulation is amended by adding the following subsection:

(2.1) The costs referred to in paragraph 5.1 of subsection (1) are the costs that the board incurred during the period beginning on September 1 of the current fiscal year and ending on March 31 of the current fiscal year, and that meet one of the following criteria:

1. The costs are eligible expenditures under the Greenhouse Gas Reduction Fund, as set out in the document titled “Memorandum 2018 B11: Capital Funding for the 2018-19 School Year”, dated April 27, 2018 and for which the board has not entered into an agreement on or before June 29, 2019.

2. The costs are approved by the Minister.

3. This Regulation comes into force on the day it is filed.
