(REGIONAL MUNICIPALITY OF YORK, TOWN OF MARKHAM)
1. The Regulation is amended by adding the following section:
85. (1) Despite sections 4 and 67, a commercial golf facility composed of an air-supported dome accommodating an indoor year-round driving range, a club house and an ancillary outdoor driving range may be erected, located and used on the land described in subsection (2) if the following requirements are met:

(2) Subsection (1) applies to that parcel of land in the Town of Markham in The Regional Municipality of York, being those parts of lots 7 and 8 in Concession 3 designated as Parts 1, 2, 3 and 4 on a Plan of Survey of Record deposited in the Land Registry Office for the Land Titles Division of York Region (No. 65) as Number 66R-6242, except that part of lot 7 designated as Parts 1, 2, 3, 4, 8, 9, 10 and 11 on a Plan of Survey of Record deposited in the Land Registry Office for the Land Titles Division of York Region (No. 65) as Number 66R-10644.
(3) Despite sections 4 and 67, a landing area for the ancillary outdoor driving range may be located and used on the land described in subsection (4).
(4) Subsection (3) applies to that parcel of land in the Town of Markham in The Regional Municipality of York, being part of lot 7 in Concession 3 designated as Parts 1, 2, 3, 4, 8, 9, 10 and 11 on a Plan of Survey of Record deposited in the Land Registry Office for the Land Titles Division of York Region (No. 65) as Number 66R-10644 and the westerly half of Part 4 on Expropriation Plan No. 11165 registered as Instrument No. MA109460.
2. Section 85 of the Regulation is revoked.
Commencement
3. (1) Subject to subsection (2), this Regulation comes into force on the day it is filed.
(2) Section 2 comes into force on July 1, 2023.
