Amending O. Reg. 137/15

(GENERAL)

1. Ontario Regulation 137/15 is amended by adding the following Part:

Part IV.1
Exemptions and extensions due to Coronavirus (Covid-19)

Exemptions and extensions

88.2 (1) In this Part,

“emergency” means the emergency declared by Order in Council 518/2020 (Ontario Regulation 50/20) on March 17, 2020 pursuant to section 7.0.1 of the Emergency Management and Civil Protection Act in the whole of the Province of Ontario as a result of the outbreak of the coronavirus (COVID-19); (“situation d’urgence”)

“emergency period” means the period during which the emergency is in effect and includes the period of extension of that emergency made under section 7.0.7 of the Emergency Management and Civil Protection Act. (“période de la situation d’urgence”)

(2) Despite subsection 58 (2), if a person referred to in paragraph 1, 2 or 3 of that subsection had a valid certification in standard first aid on the day before the first day of the emergency period, a licensee of a child care centre or home child care agency is not required to ensure that the person continues to have a valid certification in standard first aid,

(a) during the emergency period; and

(b) until such time after the end of the emergency period as it is reasonably possible for the person to have a valid certification.

(3) Despite clause 62 (1) (a), if the fifth anniversary after the date of a person’s most recent vulnerable sector check falls during the emergency period or during the 60-day period that immediately follows the end of the emergency period, a licensee of a child care centre or home child care agency is not required to obtain new vulnerable sector checks,

(a) during the emergency period; and

(b) until 60 days after the end of the emergency period.

(4) Despite section 81, the fees payable in respect of an application for a licence to operate a child care centre or a home child care agency, including an application for a new licence, a renewal of a licence or a revised licence, are zero,

(a) during the emergency period; and

(b) until 60 days after the end of the emergency period.

(5) Despite section 85.2, a licence that expires on a day that falls during the emergency period is deemed to have been renewed on that day and shall expire six months after the day it was deemed to have been renewed or on such other day as may be approved by a Director.

Commencement

2. This Regulation comes into force on the day it is filed.
