Amending O. Reg. 19/99

(ELECTRONIC REGISTRATION)

1. Subsection 2 (2) of Ontario Regulation 19/99 is revoked and the following substituted:

(2) No person shall search records in the electronic land registration system without having obtained authorization from the Director of Land Registration or a person authorized by the Director of Land Registration.

2. Clause 20 (d) of the Regulation is amended by striking out “Construction Lien Act” and substituting “Construction Act”.

3. (1) The French version of subsection 33 (1) of the Regulation is amended by striking out “d’une réclamation d’un privilège de constructeur” in the portion before clause (a) and substituting “d’une revendication de privilège de constructeur”.

(2) The French version of clause 33 (1) (a) of the Regulation is revoked and the following substituted:

a) le numéro d’enregistrement de la revendication de privilège;

(3) Subsection 33 (1) of the Regulation is amended by adding the following clause:

(a.1) a statement that no certificate of lien has been registered, if that is the case;

(4) The French version of subclauses 33 (1) (b) (i) and (ii) of the Regulation is revoked and the following substituted:

(i) soit aucune autre revendication de privilège n’a été enregistrée,

(ii) soit aucune autre revendication de privilège enregistrée n’est protégée par le certificat,

(5) Subclause 33 (1) (b) (iii) of the Regulation is amended by striking out “Construction Lien Act” at the end and substituting “Construction Act”.

(6) The French version of clause 33 (1) (c) of the Regulation is amended by striking out “la réclamation de privilège” and substituting “la revendication de privilège”.

(7) Subsection 33 (2) of the Regulation is revoked and the following substituted:

(2) The evidence mentioned in clause (1) (c) shall be in the form of,

(a) a statement by the lien claimant that the lien claimant has discharged the claim for lien;

(b) a statement that the lien has expired because no certificate of action has been registered within the required period under the Construction Act;

(c) the court order that discharges the claim for lien;

(d) the court order that discharges the claim for lien and vacates the certificate of action; or

(e) the court order that vacates the claim for lien or vacates the claim for lien and certificate of action.


Commencement

4. This Regulation comes into force on the day it is filed.
