Amending O. Reg. 101/94

(RECYCLING AND COMPOSTING OF MUNICIPAL WASTE)

1. (1) Subsection 1 (1) of Ontario Regulation 101/94 is amended by adding the following definitions:

“Blue Box Transition Schedule” has the same meaning as in Ontario Regulation 391/21 (Blue Box), made under the Resource Recovery and Circular Economy Act, 2016;

(2) The definition of “Blue Box Transition Schedule” in subsection 1 (1) of the Regulation, as made by subsection (1), is revoked.

2. (1) Section 7 of the Regulation is amended by adding the following subsection:

(8) This section does not apply to a municipality after the date in the Blue Box Transition Schedule that sets out when that municipality will start to receive collection services in accordance with Part IV of Ontario Regulation 391/21 (Blue Box), made under the Resource Recovery and Circular Economy Act, 2016.

(2) Section 7 of the Regulation is revoked.

3. Sections 8 and 9 of the Regulation are revoked.

4. Section 10 of the Regulation is revoked.

5. (1) The Regulation is amended by adding the following section:

10.1 A municipality that is included in the Blue Box Transition Schedule, that was not required to operate a system for the collection of blue box waste under section 7, and that provided a system for the collection of blue box waste as of August 15, 2019, shall continue to operate that collection system until the date in the Blue Box Transition Schedule that sets out when that municipality will start to receive collection services in accordance with Part IV of Ontario Regulation 391/21 (Blue Box), made under the Resource Recovery and Circular Economy Act, 2016.

(2) Section 10.1 of the Regulation, as made by subsection (1), is revoked.

Commencement

6. (1) Subject to subsection (2), this Regulation comes into force on the day it is filed.

(2) Subsections 1 (2) and 2 (2), section 3 and subsection 5 (2) come into force on January 1, 2026.
