Amending O. Reg. 221/08

(REGISTRATION)

1. (1) Subsection 5 (1) of Ontario Regulation 221/08 is amended by striking out “sections 25 and 64” and substituting “section 25”.

(2) Paragraph 1 of subsection 5 (2) of the Regulation is amended by adding the following subparagraphs:

iii.  Every refusal to register or issue a licence and every denial of registration or licensure by a professional association or other body that has self-regulatory responsibility.

iv.  Every allegation that has been verified by a children’s aid society or other body that has similar responsibility.

v.  Any other event that would provide reasonable grounds for the belief that the applicant would not practice safely, ethically, professionally, or competently.

(3) Paragraph 2 of subsection 5 (2) of the Regulation is amended by adding “charge and” before “finding of guilt”.

(4) Paragraph 5 of subsection 5 (2) of the Regulation is revoked.

(5) Subsection 5 (4) of the Regulation is revoked and the following substituted:

(4) An applicant who, after having applied for but before being issued a certificate of registration, becomes the subject of a matter described in paragraph 1 of subsection (2) or is charged with or found guilty of an offence described in paragraph 2 of subsection (2), shall immediately inform the Registrar.

2. (1) Paragraph 1 of section 6 of the Regulation is amended by adding the following subparagraphs:

iii.  Every refusal to register or issue a licence and every denial of registration or licensure by a professional association or other body that has self-regulatory responsibility, if the refusal or denial is made after the initial registration of the member.

iv.  Every allegation that has been verified by a children’s aid society or other body that has similar responsibility, if the verification is made after the initial registration of the member.

v.  Any other event that would provide reasonable grounds for the belief that the applicant would not practice safely, ethically, professionally, or competently.

(2) Paragraph 2 of section 6 of the Regulation is amended by adding “charge and” before “finding of guilt”.

3. (1) Subparagraph 1 v of section 7 of the Regulation is revoked.

(2) Section 7 of the Regulation is amended by adding the following paragraph:

3.  The applicant must have successfully completed the examination, assessment or other means, if any, set or approved by the College or a committee of the College, to demonstrate knowledge of matters applicable to the practice of early childhood education in Ontario.

4. Section 8 of the Regulation is revoked.

5. Section 10 of the Regulation is revoked.

Commencement

6. (1) Subject to subsection (2), this Regulation comes into force on the later of January 1, 2022 and the day it is filed.

(2) Subsection 3 (1) comes into force on January 1, 2023.
