Conduct of business

Interpretation

1. (1) In this Regulation,

“Farmers’ Market” means the part of the Terminal where growers of or dealers in agricultural products sell by wholesale;

“Farmers’ Market occupant” means a person who rents a space in the Farmers’ Market to sell their goods, wares and merchandise;

“vehicle” means a vehicle within the meaning of the Highway Traffic Act.

(2) Protocols established under this Regulation may be general or specific in their application and may differ depending on the time of day or the area of the Terminal to which they apply.

Sale of non-agricultural products

2. The manager may permit the sale of goods, wares or merchandise that are not agricultural products if the manager is of the opinion that the goods, wares or merchandise facilitate the sale of the agricultural products offered for sale at the Terminal.

Hours of operation

3. (1) The manager shall determine the opening hours of the Terminal and may set different opening hours for different activities carried out at the Terminal.

(2) The manager shall post the opening hours or otherwise communicate them to users of the Terminal.

Entry to the Terminal outside of opening hours

4. The manager may establish protocols for gaining access to the Terminal outside of opening hours where the access would be prudent for the operation of the Terminal.

Operation of vehicles and parking

5. (1) For the purpose of controlling and directing traffic, the manager may post or paint traffic and parking control signs at the Terminal with respect to,

(a)  the direction of flow of traffic;

(b)  rates of speed;

(c)  the parking of vehicles or any classes of vehicles, including,

(i)  prohibiting parking or standing,

(ii)  designating areas as parking areas, and

(iii)  designating areas as reserved parking for specified vehicles or individuals or classes of vehicles or individuals;

(d)  the operation of lifting devices, including forklifts, pallet jacks and material handling equipment used for lifting; and

(e)  the stopping of vehicles at the Terminal.

(2) Traffic and parking control signs may indicate the periods during which the content of the sign applies.

(3) The manager may establish a process for assigning parking in areas that are designated as reserved parking areas at specified times.

(4) The manager may identify persons who may direct traffic in a manner that is contrary to any traffic and parking control signs in such circumstances as the manager considers appropriate.

Sanitation

6. (1) The manager may establish protocols with respect to the cleaning and sanitation of the Terminal.

(2) The cleaning and sanitation protocols may include protocols for disposing of goods, wares, merchandise, packaging, pallets, waste or any other items.

Storage and display on docks

7. The manager may establish protocols with respect to the storage or display of goods, wares and merchandise on docks or in other public spaces.

Farmers’ Market

8. (1) The manager may establish protocols which govern the storage of goods, wares and merchandise of Farmers’ Market occupants at the Terminal.

(2) The manager may remove personal property of Farmers’ Market occupants from the Farmers’ Market during times when the Farmers’ Market is closed or on days when the Farmers’ Market occupant is not occupying that area.

Nuisance

9. The manager may establish protocols which restrict activities that cause a nuisance at the Terminal, including nuisance related to noise levels.

Communicable diseases

10. (1) If the manager is advised that there is a risk to the operations of the Terminal as a result of a communicable disease, as defined in the Health Protection and Promotion Act, the manager may develop protocols with respect to,

(a)  the prevention of the transmission of the communicable disease at the Terminal; and

(b)  ensuring the Board’s continued ability to operate the Terminal in accordance with the Board’s objects.

(2) The protocols shall be consistent with any applicable guidance issued by,

(a)  the Ministry of Health related to the protection of health; and

(b)  the Ministry of Labour, Training and Skills Development related to the protection of employees.

Revocations

11. The following Regulations are revoked:

1.  Regulation 872.

2.  Ontario Regulation 269/20.

Commencement

12. This Regulation comes into force on the later of the day subsection 4 (1) of Schedule 4 to the Main Street Recovery Act, 2020 comes into force and the day this Regulation is filed.
