Amending O. Reg. 45/22
(GENERAL)
1. Section 17 of Ontario Regulation 45/22 is amended by striking out “or” at the end of clause (e) and by adding the following clauses:
(g) a medical officer of health in respect of a request made under section 3 of the Mandatory Blood Testing Act, 2006; or
(h) the Consent and Capacity Board in respect of an order made under section 5 of the Mandatory Blood Testing Act, 2006.
2. (1) Subsection 18 (1) of the Regulation is amended by striking out “or” at the end of clause (i) and by adding the following clauses:
(k) a medical officer of health in respect of a request made under section 3 of the Mandatory Blood Testing Act, 2006; or
(l) the Consent and Capacity Board in respect of an order made under section 5 of the Mandatory Blood Testing Act, 2006.
(2) Subsection 18 (2) of the Regulation is amended by striking out “(d), (h) or (i)” and substituting “(d), (h), (i), (k) or (l)”.
3. The Regulation is amended by adding the following section:
Restriction re Mandatory Blood Testing Act, 2006
20.1 The owner and the operator of a laboratory shall ensure that no person employed in the laboratory performs a test analysing a blood sample for the purposes of section 3 or 5 of the Mandatory Blood Testing Act, 2006 unless the laboratory is,
(a) the Ontario Agency for Health Protection and Promotion’s Public Health Lab — Toronto; or
(b) prescribed for the purpose of the definition of “analyst” under section 1 of that Act.
4. Subsection 24 (2) of the Regulation is revoked and the following substituted:
(2) Clause (1) (a) does not apply in the case of,
(a) a requisition in respect of a test that is funded under the provincial colorectal cancer screening program and that is made by a person described in clause 18 (1) (j); or
(b) a requisition in respect of a test analysing a blood sample for the purposes of section 3 or 5 of the Mandatory Blood Testing Act, 2006.
5. The Regulation is amended by adding the following section:
Reporting obligations — Mandatory Blood Testing Act, 2006
24.1 The owner and the operator of a laboratory in which tests analysing blood samples for the purposes of section 3 or 5 of the Mandatory Blood Testing Act, 2006 are performed shall ensure that the results of the tests are reported in accordance with that Act.

6. This Regulation comes into force on July 1, 2023.
