Amending O. Reg. 134/98
(GENERAL)
1. (1) Subparagraph 1 ii of subsection 55 (1) of Ontario Regulation 134/98 is amended by striking out “other than a periodic oculo-visual assessment as referred to in paragraph 1.1” and substituting “other than a service described in paragraph 1.1”.
(2) Paragraph 1.1 of subsection 55 (1) of the Regulation is revoked and the following substituted:
1.1 Subject to subsection (1.0.0.1), for every member of the benefit unit once every 24 months, an amount equal to,
i. $48.00 for a periodic oculo-visual assessment performed by an optometrist, or
ii. $50.65 for a periodic oculo-visual assessment performed by a physician.
(3) Subparagraph 1.1 i of subsection 55 (1) of the Regulation, as made by subsection (2), is amended by striking out “periodic oculo-visual assessment” and substituting “major oculo-visual examination”.
(4) Subsection 55 (1.0.0.1) of the Regulation is revoked and the following substituted:
(1.0.0.1) An amount under paragraph 1.1 of subsection (1) is only payable if,
(a) the member of the benefit unit has not had a periodic oculo-visual assessment, a major oculo-visual examination or a major eye examination within the preceding 24 months; and
(b) the member of the benefit unit is not entitled to payment on his or her behalf for the periodic oculo-visual assessment, the major oculo-visual examination or the major eye examination under the Ontario Health Insurance Plan established under the Health Insurance Act.
(5) Subsection 55 (5) of the Regulation is revoked and the following substituted:
(5) In this section,
“major eye examination” has the same meaning as a major eye examination as described in the document referred to in,
(a) the definition of “schedule of optometry benefits” in subsection 1 (1) of Regulation 552 of the Revised Regulations of Ontario, 1990 made under the Health Insurance Act, as that definition read on April 1, 2023, when the examination is performed by an optometrist, or
(b) the definition of “schedule of benefits” in subsection 1 (1) of Regulation 552 of the Revised Regulations of Ontario, 1990 made under the Health Insurance Act, when the examination is performed by a physician; (“examen de la vue majeur”)
“periodic oculo-visual assessment” has the same meaning as a periodic oculo-visual assessment as described in the document referred to in,
(a) the definition of “schedule of optometry benefits” in subsection 1 (1) of Regulation 552 of the Revised Regulations of Ontario, 1990 made under the Health Insurance Act, as that definition read on April 1, 2023, when the assessment is performed by an optometrist, or
(b) the definition of “schedule of benefits” in subsection 1 (1) of Regulation 552 of the Revised Regulations of Ontario, 1990 made under the Health Insurance Act, when the assessment is performed by a physician. (“bilan oculo-visuel périodique”)
(6) Subsection 55 (5) of the Regulation, as remade by subsection (5), is amended by adding the following definition:
“major oculo-visual examination” has the same meaning as a major oculo-visual examination as described in the document referred to in the definition of “schedule of optometry benefits” in subsection 1 (1) of Regulation 552 of the Revised Regulations of Ontario, 1990 made under the Health Insurance Act; (“examen oculo-visuel majeur”)
Commencement
2. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.
(2) Subsections 1 (1), (2) and (5) come into force on April 1, 2023 or, if this Regulation is filed after that day, are deemed to have come into force on that day.
(3) Subsections 1 (3), (4) and (6) come into force on September 1, 2023 or, if this Regulation is filed after that day, are deemed to have come into force on that day.
