Amending O. Reg. 340/94
(DRIVERS’ LICENCES)
1. Clause 16 (i) of Ontario Regulation 340/94 is revoked and the following substituted:
(i) any holder of a driver’s licence with an air brake endorsement complete successfully the demonstration prescribed in clause 15 (1) (c) at any time that he or she is required under clauses (a), (b), (c) or (h) to complete the demonstration prescribed in clause 15 (1) (b);
(j) any holder of a driver’s licence with an air brake endorsement complete successfully the examination prescribed in clause 15 (1) (d) at any time that he or she is required under clauses (b) or (c) to take the examination prescribed in clause 15 (1) (a).
2. (1) The Regulation is amended by adding the following section:
16.1 The Minister may permit the holder of a driver’s licence with an air brake endorsement to complete air brake online learning modules approved by the Minister through the Ontario Driver Certification Program instead of the examination prescribed under clause 15 (1) (d).
(2) Section 16.1 of the Regulation, as made by subsection (1), is revoked and the following substituted:
16.1 The Minister may require the holder of a driver’s licence with an air brake endorsement to complete air brake online learning modules approved by the Minister,
(a) every five years, if the holder has not reached the age of 80; or
(b) every year, if the holder has reached the age of 80.
3. Subsection 26 (1) of the Regulation is amended by adding the following paragraphs:
5.1 For air brake online learning modules, $16.

6.2 For a Class A, B, C, D, E or F driver’s knowledge test and air brake online learning modules, $23.75.
4. (1) Subsection 26.0.1 (2) of the Regulation is amended by striking out “the results of examinations of” and substituting “the results of examinations and air brake online learning modules completed by”.
(2) Subsection 26.0.1 (3) of the Regulation is amended by adding “or the air brake online learning modules” after “and testing”.
(3) Clause (a) of the definition of “Ontario Driver Certification Program” in subsection 26.0.1 (4) of the Regulation is revoked and the following substituted:
(a) monitors the training and testing of driver trainees as well as the completion of air brake online learning modules administered to driver trainees by recognized authorities,
(4) The definition of “Ontario Driver Certification Program” in subsection 26.0.1 (4) of the Regulation is amended by striking out “and” at the end of clause (a), by adding “and” at the end of clause (b) and by adding the following clause:
(c) recognizes the results of air brake online learning modules completed by driver trainees under section 16.1 that are submitted to the Ministry by recognized authorities;
(5) The definition of “recognized authority” in subsection 26.0.1 (4) of the Regulation is revoked and the following substituted:
“recognized authority” means a corporation or other entity that is recognized by the Ministry as competent to train and test driver trainees and to administer air brake online learning modules to driver trainees under the Ontario Driver Certification Program. (“autorité reconnue”)
Commencement
5. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.
(2) Subsection 2 (1) and section 4 come into force on the later of May 8, 2023 and the day this Regulation is filed.
(3) Section 1, subsection 2 (2) and section 3 come into force on the later of September 1, 2023 and the day this Regulation is filed.
