Amending O. Reg. 279/02

(GENERAL)

1. Part I.1 of Ontario Regulation 279/02 is amended by adding the following section:

Conditions for a consent

1.0.1 The following conditions are prescribed for the purposes of subsection 4 (6) of the Act as conditions that must be satisfied before the Minister, despite subsection 4 (5) of the Act, may give a consent to authorize a college of applied arts and technology to do something described in section 2 of the Act:

1.  The proposed program leads to a master’s degree in an applied area of study.

2.  The college,

i.  has a consent to grant a baccalaureate degree in the same area of study as the proposed degree program or a related area, or

ii.  has applied for such a consent and the application is outstanding.

3.  The college has demonstrated to the satisfaction of the Minister that the proposed degree program,

i.  would include a significant work-integrated learning component in a relevant occupational field,

ii.  is in an area of study that is directly linked to current labour market needs in Ontario,

iii.  would not pose a serious risk to the viability of any other degree program offered by a publicly-assisted university within the meaning of the Ministry of Training, Colleges and Universities Act or by a college of applied arts and technology, including a degree program offered by the applicant, and

iv.  would not be substantially similar to any other degree program currently offered by a publicly-assisted university within the meaning of the Ministry of Training, Colleges and Universities Act or by a college of applied arts and technology, including a degree program offered by the applicant.

2. Subsection 19 (2) of the Regulation is amended by striking out “Section 20” at the beginning and substituting “Section 21”.

3. Paragraph 17 of the Schedule to the Regulation is revoked and the following substituted:

17.  St. Augustine’s Seminary of Toronto.

Commencement

4. This Regulation comes into force on the later of July 1, 2024 and the day this Regulation is filed.
