Amending O. Reg. 877/21
(GENERAL)
1. The heading before section 1 of Ontario Regulation 877/21 is revoked and the following substituted:
Ratios, Certificates and Apprenticeship
2. Paragraph 2 of section 2 of the Regulation is revoked and the following substituted:
2. A document issued by the Ministry confirming that the individual is a party to a registered training agreement, including a document issued by the Ministry under the Ontario College of Trades and Apprenticeship Act, 2009 that constituted proof of apprenticeship under that Act.
2.1 A document issued by Skilled Trades Ontario confirming that the individual is a party to a registered training agreement.
3. (1) Paragraph 2 of subsection 5 (1) of the Regulation is amended by striking out “the Table to this section” and substituting “Table 1”.
(2) Section 5 of the Regulation is amended by adding the following subsections:
(1.1) The following criteria are prescribed for the purposes of clause 15 (1) (b) of the Act as criteria that must be met for the registration of a training agreement:
1. The sponsor is not,
i. the board of directors of the Corporation or a committee of the board, or
ii. the individual who is applying for registration as an apprentice.
2. If the sponsor is an educational institution, the Registrar is satisfied that the registration of the training agreement would not result in a real or perceived conflict of interest in respect of the sponsor.
3. The Registrar is satisfied that the sponsor will be able to comply with the terms of the training agreement.
(1.2) For the purposes of clause 15 (1) (d) of the Act, for the registration of a training agreement in a trade set out in Column 1 of Table 2, the pre-requisites set out in Column 2 of the Table opposite the trade are prescribed as other criteria that must be satisfied.
(3) The title of the Table to section 5 of the Regulation is revoked and the following substituted:

(4) Section 5 of the Regulation is amended by adding the following Table:

Pre-Requisites

1. | Chef | The individual holds a certificate of qualification with red seal endorsement in the trade of cook, and has at least one year of related work experience after the date on which they received their red seal certification. |

3. | Die designer | The individual holds a certificate of qualification in the trade of tool and die maker. |

5. | Refractory mason | The individual holds a certificate of qualification in the trade of brick and stone mason. |
6. | Tool and gauge inspector | The individual holds a certificate of qualification in the trade of tool and die maker. |
7. | Elevating devices mechanic | The individual holds a certificate issued under Ontario Regulation 222/01 (Certification and Training of Elevating Device Mechanics) made under the Technical Standards and Safety Act, 2000, designating them as an elevating device mechanic-in-training, class T. |
4. Sections 6 and 6.1 of the Regulation are revoked.
5. The definition of “out-of-province regulatory authority” in subsection 10 (2) of the Regulation is amended by striking out “the Agreement on Internal Trade” and substituting “the Canadian Free Trade Agreement”.
6. Section 14 of the Regulation is amended by adding the following subsection:
(2) A certificate of apprenticeship issued by the Minister under subsection 16 (1) of the Act that was valid immediately before April 2, 2025 is deemed on that day to be a certificate of apprenticeship issued by the Registrar under subsection 16 (1) of the Act.
7. Section 15 of the Regulation is amended by adding the following subsections:
(4) A registered training agreement registered by the Minister under subsection 15 (1) of the Act that was valid immediately before April 2, 2025 is deemed on that day to be a registered training agreement registered by the Registrar under subsection 15 (1) of the Act.
(5) A registered training agreement registered by the Minister under subsection 15 (1) of the Act that was a suspended agreement immediately before April 2, 2025 is deemed on that day to be a suspended agreement registered by the Registrar under subsection 15 (1) of the Act.
8. Section 18 of the Regulation is revoked and the following substituted:

Register
18. (1) The following information is prescribed for the purposes of clause 47 (g) of the Act as information to be kept in the public register:
1. The unique identification number provided by Skilled Trades Ontario for each individual who holds a certificate of qualification or provisional certificate of qualification in a compulsory trade or is an apprentice working in a compulsory trade pursuant to a registered training agreement that is not suspended.
2. For every certificate of qualification or provisional certificate of qualification in a compulsory trade,
i. the issuance date and expiration date of the certificate,
ii. if the certificate has not expired or been suspended or revoked, a notation indicating an active status, and
iii. if the certificate has expired, a notation indicating an expired status.
3. For every apprentice working in a compulsory trade pursuant to a registered training agreement that is not suspended,
i. the registration date of the registered training agreement, and
ii. if the registered training agreement is not suspended or revoked, a notation indicating that the registered training agreement is active.
(2) Despite section 47 of the Act, the Registrar shall not include in the public register information concerning an individual who is receiving training and work experience in a trade while participating in a program described in clause 1 (1) (a), (b) or (c).
Service
19. (1) For the purposes of clause 61 (1) (d) of the Act, email is prescribed as an alternative method for serving a notice or document.
(2) Subject to subsection (3), service of a notice or document sent by email on a Saturday, Sunday or a holiday or on any other day after 5 p.m. is effective on the next day that is not a Saturday, Sunday or holiday.
(3) Subsection (2) does not apply if the person on whom the notice or document is served establishes that the person did not, acting in good faith, through absence, accident, illness or other cause beyond the person’s control, receive the notice or document until a later date.

9. This Regulation comes into force on the day it is filed.
