Amending O. Reg. 99/23

(LICENSING — TEMPORARY HELP AGENCIES AND RECRUITERS)

1. Subsection 3 (1) of Ontario Regulation 99/23 is amended by striking out “$750” and substituting “$1,500”.

2. (1) Subclause 3.1 (1) (a) (i) of the Regulation is amended by striking out “less than a year” and substituting “less than two years”.

(2) Section 3.1 of the Regulation is amended by adding the following subsection:

(3) If an applicant applies for both a temporary help agency licence and a recruiter licence and one application is made before January 1, 2026 and the other is made on or after January 1, 2026, this section as it read immediately before January 1, 2026 applies in respect of those applications.

3. The Regulation is amended by adding the following section:

Expiry of licence

7.1 (1) For the purposes of subsection 74.1.10 (1) of the Act, a longer period of two years is prescribed.

(2) The longer period prescribed under subsection (1) does not apply in respect of a licence if,

(a)  the application for the licence or renewal of the licence is made before January 1, 2026 but the licence is issued on or after January 1, 2026; or

(b)  the applicant for the licence is exempt from paying an application fee under subsection 3.1 (1) and the application fee in respect of the other licence or renewal was paid before January 1, 2026.

Commencement

4. This Regulation comes into force on the later of January 1, 2026 and the day this Regulation is filed.
