(GENERAL)
1. Ontario Regulation 167/23 is amended by adding the following section:
Non-application re specified towing services
6.1 (1) Except as otherwise provided in this section, any provisions of the Act or the regulations that apply to towing services, tow operators or tow truck drivers do not apply with respect to the provision of a towing service that meets the following criteria, if the person providing the towing service is listed in subsection (2) and holds a valid CVOR certificate:
1. The tow truck used to provide the towing service has a flatbed that can tilt to load and is clearly emblazoned on both sides with the person’s name.
2. The motor vehicle being towed is owned by the person or is being towed for the purposes of,
i. being purchased or sold by the person, or
ii. being inspected for the purpose of being purchased or sold by the person.
3. The towing service is not being provided at the scene of a collision or for a vehicle that is disabled on a highway or shoulder of a highway.
4. The person has provided the tow truck driver who is driving the tow truck described in paragraph 1 with,
i. a copy of the person’s CVOR certificate,
ii. if the motor vehicle being towed is owned by the person, evidence of the ownership, and
iii. if the motor vehicle being towed is not owned by the person,
A. an agreement to purchase or sell the vehicle, or
B. an agreement to inspect the vehicle for the purpose of purchase or sale.
(2) The following persons are listed for the purposes of subsection (1):
1. Clutch Technologies Inc.
(3) An agreement mentioned in subparagraph 4 iii of subsection (1) must identify the vehicle identification number of the motor vehicle being towed.
(4) A person listed in subsection (2) shall not allow a tow truck emblazoned with their name to be used by another tow operator.
(5) A tow truck driver who is providing a towing service described in subsection (1) shall, on the demand of a police officer or inspector, surrender for inspection any of the documents set out in paragraph 4 of that subsection.
(6) If a document required to be surrendered under subsection (5) is in an electronic format, the tow truck driver shall produce the document in accordance with subsection 18 (2).
Commencement
2. This Regulation comes into force the later of January 1, 2026 and the day this Regulation is filed.
