Amending O. Reg. 91/23
(ZONING ORDER - CITY OF MISSISSAUGA, REGIONAL MUNICIPALITY OF PEEL)
1. Section 2 of Ontario Regulation 91/23 is amended by striking out “Map 332, Map 333 and Map 334” and substituting “Map 386, Map 387 and Map 388”.
2. (1) Subsection 3 (1) of the Regulation is amended by striking out “Map 332” and substituting “Map 333”.
(2) Subsection 3 (3) of the Regulation is amended by striking out “0025-2007” and substituting “0225-2007”.
(3) Paragraph 2 of subsection 3 (4) of the Regulation is amended by striking out “Map 334” and substituting “Map 388”.
(4) Paragraphs 3 to 7 of subsection 3 (4) of the Regulation are revoked and the following substituted:
3. The maximum height of the portion of a building or structure within a 20 metre setback from the line identified as “10-C” on Map 388 is 10 storeys.
4. The maximum height of the portion of a building or structure within a five metre setback from the line identified as “10-D” on Map 388 is 10 storeys.
5. Any block of land shall be considered one lot if it is bordered on all sides by one or more of the following:
i. A street.
ii. A public park.
iii. Lands outside the subject lands identified on Map 388.
iv. Any other block on a registered plan.
6. If the uses permitted in clauses 4 (1) (e) and (f) are proposed within a block on a registered plan, that block shall be considered one lot.
7. If a lot has frontage on two or more streets, except for a corner lot having only two street frontages, each lot line abutting a street shall be considered a front lot line for the purposes of applying minimum setbacks, front yard requirements and other provisions applicable to a front lot line.
8. An outdoor patio and structures accessory thereto may be permitted in a landscaped buffer and no setbacks are required.
9. The minimum setback of all buildings, structures, paved areas and trails in a non-residential zone to all lands identified as Greenbelt 1-B (G1-B) Zone on Map 387 is 0.0 metres.
(5) Paragraphs 1 to 9 of subsection 3 (5) of the Regulation are revoked.
(6) Paragraph 12 of subsection 3 (5) of the Regulation is revoked and the following substituted:
12. A maximum of 10 per cent of the parking spaces are not required to comply with sections 3.1.1.4.1, 3.1.1.4.3, 3.1.1.4.4 and 3.1.1.5.1 of zoning by-law no. 0225-2007.
3. (1) Subsection 4 (1) of the Regulation is amended by striking out “Map 333” in the portion before clause (a) and substituting “Map 387”.
(2) Clause 4 (1) (g) of the Regulation is revoked.
(3) Subsection 4 (1) of the Regulation is amended by striking out “and” at the end of clause (j) and by adding the following clauses:
(l) an attached additional residential unit (Attached ARU); and
(m) a detached additional residential unit (Detached ARU).
(4) Subsection 4 (2) of the Regulation is amended by striking out “Map 333” in the portion before paragraph 1 and substituting “Map 387”.
(5) Paragraphs 6 and 11 of subsection 4 (2) of the Regulation are amended by striking out “Map 333” wherever it appears and substituting in each case “Map 387”.
(6) Paragraph 13 of subsection 4 (2) of the Regulation is revoked and the following substituted:
13. The minimum amenity area is the lesser of 2.8 square metres per dwelling unit or five per cent of the lot.
(7) Subsection 4 (2) of the Regulation is amended by adding the following paragraph:
17. A medical office shall only be permitted below the third storey of a building.
(8) Subsection 4 (3) of the Regulation is amended by striking out “Map 333” at the end of the portion before paragraph 1 and substituting “Map 387”.
(9) Paragraph 3 of subsection 4 (3) of the Regulation is amended by striking out “Map 334” and substituting “Map 388”.
(10) Paragraph 6 of subsection 4 (3) of the Regulation is revoked and the following substituted:
6. The minimum rear yard is 3.0 metres.
(11) Paragraphs 7, 8, 12, 13, 14 and 15 of subsection 4 (3) of the Regulation are amended by striking out “Map 333” wherever it appears and substituting in each case “Map 387”.
(12) Paragraph 5 of subsection 4 (5) of the Regulation is amended by striking out “Map 333” and substituting “Map 387”.
(13) Paragraph 16 of subsection 4 (5) of the Regulation is revoked and the following substituted:
16. The minimum setback from the rear wall of a building to the side wall of another building on the same lot is 8.0 metres.
(14) Paragraph 21 of subsection 4 (5) of the Regulation is amended by striking out “Map 333” and substituting “Map 387”.
(15) Subsection 4 (7) of the Regulation is revoked and the following substituted:
(7) The zoning requirements set out in Lines 4.0 to 11.0 in Table 2.1.9.1 of zoning by-law no. 0225-2007 shall not apply to a public school.
(8) The minimum amount of required parking to be located underground for a public school is 80 per cent.
(9) Section 4.1.1 of zoning by-law no. 0225-2007 shall apply to uses permitted under clauses (1) (l) and (m) of this section.
4. (1) Subsection 5 (1) of the Regulation is amended by striking out “Map 333” in the portion before clause (a) and substituting “Map 387”.
(2) Subsection 5 (2) of the Regulation is amended by striking out “Map 333” wherever it appears and substituting in each case “Map 387”.
(3) Subsection 5 (3) of the Regulation is amended by striking out “Map 334” in the portion before paragraph 1 and substituting “Map 388”.
(4) Paragraph 2 of subsection 5 (3) of the Regulation is amended by striking out “Map 333” and substituting “Map 387”.
(5) Subsection 5 (4) of the Regulation is amended by striking out “Map 333” in the portion before paragraph 1 and substituting “Map 387”.
(6) Subsection 5 (5) of the Regulation is amended by striking out “Map 333” at the end and substituting “Map 387”.
5. (1) Subsection 6 (1) of the Regulation is amended by striking out “Map 333” in the portion before clause (a) and substituting “Map 387”.
(2) Clause 6 (1) (h) of the Regulation is revoked.
(3) Subsection 6 (2) of the Regulation is amended by striking out “Map 333” wherever it appears and substituting in each case “Map 387”.
(4) Paragraph 15 of subsection 6 (2) of the Regulation is revoked and the following substituted:
15. The maximum amount of parking spaces to be provided as surface parking is,
i. 35 per cent for any building or use of an essential emergency service, and
ii. 10 per cent for all other uses.
16. A restaurant, including a take-out restaurant, may be an accessory to a building or structure used as a manufacturing facility, a science and technology facility, a warehouse or distribution facility, a commercial school, a banquet hall, a conference centre or convention centre, a university or college, a district energy system or plant, a community cultural centre or a broadcasting or communication facility, if the restaurant is wholly within the building or structure.
(5) Subsections 6 (3) and (4) of the Regulation are revoked and the following substituted:
(3) Despite anything to the contrary in this Order, an essential emergency service, a power generating facility, a district energy system or plant, an educational or public facility and a utility building shall not be subject to any zoning requirements other than those set out in paragraph 15 of subsection (2).
6. (1) Subsection 7 (1) of the Regulation is amended by striking out “Map 333” in the portion before clause (a) and substituting “Map 387”.
(2) Subsection 7 (2) of the Regulation is revoked and the following substituted:
(2) The zoning requirements set out in sections 1, 2, 9.1 and 9.2 of zoning by-law no. 0225-2007 shall apply to the lands identified as Open Space 2 (OS2) Zone on Map 387, except,
(a) there are no parking requirements for any of the permitted uses set out in subsection (1);
(b) the minimum landscaped buffer abutting all lot lines is 0.0 metres; and
(c) the minimum setback of a building or structure to a lot line abutting a Residential Apartment (RA5) Z or a Commercial 4 (C4) Zone is 1.75 metres and is 0.0 metres to all other lot lines.
7. Section 8 of the Regulation is amended by striking out “Map 333” wherever it appears and substituting in each case “Map 387”.
8. Section 9 of the Regulation is amended by striking out “Map 333” wherever it appears and substituting in each case “Map 387”.
9. Section 10 of the Regulation is amended by striking out “Map 333” wherever it appears and substituting in each case “Map 387”.

10. This Regulation comes into force on the day it is filed.
