Amending O. Reg. 63/16

(REGISTRATIONS UNDER PART II.2 OF THE ACT - WATER TAKING)

1. (1) Section 4 of Ontario Regulation 63/16 is amended by striking out “project forms” wherever it appears and substituting in each case “project is or forms”.

(2) The French version of paragraph 2 of subsection 4 (1) of the Regulation is amended by striking out “les conditions suivantes sont réunies” and substituting “l’une ou l’autre des conditions suivantes est réunie”.

(3) The English version of subparagraph 2 i of subsection 4 (1) of the Regulation is amended by striking out “and” at the end and substituting “or”.

(4) Subsection 4 (1) of the Regulation is amended by adding the following paragraph:

4.  If the highway project or transit project is or forms part of a Part II.4 project to which the Environmental Assessment Act applies, all of the requirements prescribed under that Act for commencing the Part II.4 project have been met.

(5) Subsection 4 (4) of the Regulation is revoked and the following substituted:

“Part II.3 project”, “Part II.4 project” and “undertaking” have the same meaning as in the Environmental Assessment Act.

Commencement

2. This Regulation comes into force on the later of January 1, 2027 and the day this Regulation is filed.
