Amending O. Reg. 134/98

(GENERAL)

1. (1) Paragraphs 1 to 3 of subsection 6 (1) of Ontario Regulation 134/98 are revoked and the following substituted:

1.  Subject to subsection (3), a person who is not authorized to remain in Canada under the Immigration and Refugee Protection Act (Canada) or who is only authorized by the Government of Canada to remain in Canada on a temporary basis, unless the person,

i.  has made a claim for refugee protection under the Immigration and Refugee Protection Act (Canada), or

ii.  has made an application for status as a permanent resident under that Act.

2.  A person with respect to whom a removal order has become enforceable under the Immigration and Refugee Protection Act (Canada), unless the administrator is satisfied that the person has made an application for status as a permanent resident on the basis of humanitarian and compassionate considerations, as referred to in subsection 25 (1) of that Act.

(2) Subsection 6 (2) of the Regulation is revoked.

(3) Subsection 6 (3) of the Regulation is amended by striking out “Paragraph 2 of subsection (1) does not apply with respect to a person” at the beginning and substituting “Paragraph 1 of subsection (1) does not apply with respect to a person who is only authorized by the Government of Canada to remain in Canada on a temporary basis”.

2. This Regulation comes into force on the day it is filed.
