Amending O. Reg. 222/98

(GENERAL)

1. Section 8 of Ontario Regulation 222/98 is revoked and the following substituted:

Status in the Country

8. The following persons are not eligible for income support:

1.  A person who is not authorized to remain in Canada under the Immigration and Refugee Protection Act (Canada) or who is only authorized by the Government of Canada to remain in Canada on a temporary basis, unless the person,

i.  has made a claim for refugee protection under the Immigration and Refugee Protection Act (Canada), or

ii.  has made an application for status as a permanent resident under that Act.

2.  A person with respect to whom a removal order has become enforceable under the Immigration and Refugee Protection Act (Canada), unless the Director is satisfied that the person has made an application for status as a permanent resident on the basis of humanitarian and compassionate considerations, as referred to in subsection 25 (1) of that Act.

Commencement

2. This Regulation comes into force on the day it is filed.
