Cooling-Off Period
Definitions
1. In this Regulation,
“parcel of tied land” means, when used in respect of a common elements condominium corporation, a parcel of land described in clause 139 (1) (a) of the Condominium Act, 1998 to which a common interest of an owner in the common elements condominium corporation attaches under clause 139 (2) (a) of that Act; (“parcelle de bien-fonds lié”)
“vacant land condominium corporation” has the same meaning as in subsection 1 (1) of the Condominium Act, 1998. (“association condominiale de terrain nu”)
Non-application of the Act
2. (1) Section 53.2 of the Act does not apply in respect of a purchase agreement for a new freehold home if any of the following criteria is satisfied:
1. The purchase agreement is entered into before January 1, 2027.
2. The new freehold home is on a unit in a vacant land condominium corporation.
3. The new freehold home is on a parcel of tied land for a common elements condominium corporation.
(2) Section 53.2 of the Act does not apply in respect of a construction contract.
Cooling-off period for new freehold homes, prescribed information
3. For the purposes of clause 53.2 (1) (a) of the Act, the prescribed information that the vendor shall deliver to the purchaser is a copy of the following:
1. The document mentioned in either subclause 7 (1) (a) (i) or (ii) of Ontario Regulation 289/26 (Addenda and Information Sheets for Purchase Agreements) made under the Act.
2. The document mentioned in clause 7 (1) (b) of Ontario Regulation 289/26 (Addenda and Information Sheets for Purchase Agreements) made under the Act.
Cooling-off period for new freehold homes, prescribed requirement
4. For the purposes of clause 53.2 (1) (b) of the Act, the prescribed requirements are that the documents delivered to the purchaser under section 3 of this Regulation must be signed by the vendor and the purchaser.
Commencement
5. This Regulation comes into force on the later of the day section 4 of Schedule 1 to the Homeowner Protection Act, 2024 comes into force and the day this Regulation is filed.
