Amending O. Reg. 194/24

(ZONING ORDER — ONTARIO PLACE)

1. (1) Subsection 1 (1) of Ontario Regulation 194/24 is amended by adding the following definition:

“areaway” means a reinforced opening in the ground adjacent to the main wall of a building that is used to provide access to light and ventilation for the below ground portions of a building;

(2) The definition of “publicly accessible open space” in subsection 1 (1) of the Regulation is amended by adding “stairs, art, sculptures” after “beaches”.

2. (1) Sub-sub-sub paragraph 3 iii B 1 of subsection 6 (6) of the Regulation is revoked and the following substituted:

1. The space may be reduced to a width of 6 metres and must contain only a multi-use path where the space is either below any portion of the west island covered by a bridge connecting to the Block 4 mainland, is within 40 metres of that bridge or adjacent to the mechanical area projections permitted by sub-sub paragraph 10 v D.

(2) Subparagraph 10 i of subsection 6 (6) of the Regulation is amended by adding “set out in subparagraph v” at the end.

(3) Paragraph 10 of subsection 6 (6) of the Regulation is amended by adding the following subparagraph:

v. The following permitted projections may extend beyond the building envelope:

A. Stairs.

B. Retaining walls.

C. Ramps used only for pedestrian purposes.

D. Mechanical equipment, including battery storage, within a maximum of two areas, subject to the following:

1. One area must abut the portion of the building envelope identified as the lines having bearings of N0°18'20"W and N31°58'00"W on Reference Plan 66R-34049 and is limited to a maximum area of 500 square metres.

2. One area must abut the portion of the building envelope located between Point ID 77 and Point ID 81 on Plan 66R-34049.

3. Equipment must be partially or fully enclosed and visually screened from adjacent areas outside the building envelope.

E. Areaways and associated screens, covers or railings to a maximum projection of 2 metres.

(4) Paragraphs 11 and 13 of subsection 6 (6) of the Regulation are revoked and the following substituted:

11. The building described in paragraph 10 excludes any portion used for a bridge connecting the west island to the Block 4 mainland, including associated ramps, and such bridge may be enclosed and include gross floor area.

13. Any building or structure on the Block 4 mainland must be set back at least 6 metres from the Martin Goodman Trail, excluding ramps, stairs, bicycle parking facilities and bridges.

3. This Regulation comes into force on the day it is filed.
