Amending O. Reg. 176/10

(TEACHERS' QUALIFICATIONS)

1. (1) Subsection 1 (1) of Ontario Regulation 176/10 is amended by adding the following definition:

“four-semester program of professional education” means a teacher education program that was accredited under the accreditation regulation, as that regulation read on April 30, 2027, but that does not satisfy the requirements for accreditation set out in the accreditation regulation as that regulation reads on and after May 1, 2027 and includes a program that remains accredited under clause 15.3 (2) (a) of the accreditation regulation; (“programme de formation professionnelle de quatre semestres”)

(2) The definition of “program of professional education” in subsection 1 (1) of the Regulation is revoked and the following substituted:

“program of professional education” means,

(a)  a program described in subsection 1 (2), (3) or (4) of the accreditation regulation that is accredited by the College,

(b)  a one-year program of professional education,

(c)  a four-semester program of professional education, or

(d)  a teacher education program provided outside Ontario that is acceptable to the College and not substantially different from a program described in clause (a); (“programme de formation professionnelle”)

(3) The English version of subsection 1 (2) of the Regulation is amended by striking out “he or she has” and substituting “they have”.

(4) The English version of subsection 1 (3) of the Regulation is amended by striking out “he or she” wherever it appears and substituting in each case “the applicant”.

2. (1) Subsections 4 (1) and (2) of the Regulation are revoked and the following substituted:

Application requirements, applicant completed program of professional education in Ontario

(1) A person who has completed a program described in clause (a), (b) or (c) of the definition of “program of professional education” in subsection 1 (1) may apply for a certificate of qualification and registration in accordance with subsection (3).

(2) Subsection (1) does not apply to a person who completes a four-semester program of professional education after September 30, 2028, unless the evidence submitted under clause (3) (j) satisfies the Registrar that exceptional circumstances prevented the person from completing the program on or before that date.

(2) Subsection 4 (3) of the Regulation is amended by striking out “or (2)” in the portion before clause (a).

(3) Subsection 4 (3) of the Regulation is amended by adding the following clause:

(j)  in the case of an applicant who completes a four-semester program of professional education after September 30, 2028, evidence demonstrating that exceptional circumstances prevented the applicant from completing the program on or before that date.

3. The English version of subsection 5 (2) of the Regulation is amended by striking out “he or she” and substituting “they”.

4. The English version of clause 6.1 (3) (f) of the Regulation is amended by striking out “he or she” and substituting “they”.

5. The English version of clause 6.2 (3) (f) of the Regulation is amended by striking out “he or she” and substituting “they”.

6. The English version of subsection 8 (1) of the Regulation is amended by striking out “him or her” and substituting “the Registrar”.

7. The English version of section 9 of the Regulation is amended by striking out “him or her” wherever it appears and substituting in each case “the applicant”.

8. Subsection 11 (1) of the Regulation is amended by adding the following clause:

(0.a)  in the case of an applicant under subsection 4 (1), completed a program described in clause (a) or (c) of the definition of “program of professional education” in subsection 1 (1);

9. (1) Subsection 12 (1) of the Regulation is amended by striking out “subsection 4 (2) or” in the portion before clause (a) and substituting “subsection 4 (1) or an applicant under”.

(2) Clause 12 (1) (c) of the Regulation is revoked and the following substituted:

(c)  for an applicant described in subsection 4 (1), the applicant completed a one-year program of professional education;

(3) Paragraph 4 of subsection 12 (2) of the Regulation is amended by striking out “four” and substituting “three”.

(4) The English version of subsection 12 (6) of the Regulation is amended by striking out “that he or she is a member of the College in good standing and that there are exceptional circumstances that prevented him or her” and substituting “that the holder is a member of the College in good standing and that there are exceptional circumstances that prevented them”.

10. Section 16 of the Regulation is amended by adding the following subsection:

(3) Despite subsection (1), if the transitional or multi-session transitional certificate of qualification and registration was granted to a person enrolled in a four-semester program of professional education, the Registrar shall not grant the corresponding general certificate of qualification and registration unless,

(a)  the person completed the program on or before September 30, 2028; or

(b)  the person completed the program after September 30, 2028 and the evidence submitted under clause 4 (3) (j) satisfies the Registrar that exceptional circumstances prevented the person from completing the program on or before that date.

11. The English version of clause 21 (d) of the Regulation is amended by striking out “he or she has” and substituting “they have”.

12. The English version of subsection 25 (3) of the Regulation is amended by striking out “he or she” and substituting “the person”.

13. The English version of subclause 26 (2) (a) (iii) of the Regulation is amended by striking out “he or she” and substituting “they”.

14. (1) The English version of subsection 32 (1) of the Regulation is amended by striking out “he or she” in the portion before clause (a) and substituting “the candidate”.

(2) The English version of subsection 32 (1.1) of the Regulation is amended by striking out “he or she has” and substituting “they have”.

(3) The English version of subsection 32 (2) of the Regulation is amended by striking out “he or she was” and substituting “they were”.

15. The English version of subsection 33 (1) of the Regulation is amended by striking out “he or she” in the portion before clause (a) and substituting “the candidate”.

16. (1) The English version of subsection 35 (1) of the Regulation is amended by striking out “at the time he or she was admitted to the program, he or she met all of the requirements” and substituting “at the time the candidate was admitted to the program, they met all of the requirements”.

(2) The English version of subsection 35 (4) of the Regulation is amended by striking out “he or she was” and substituting “they were”.

(3) The English version of subsection 35 (4.1) of the Regulation is amended by striking out “he or she has” and substituting “they have”.

17. (1) The English version of subsection 36 (3) of the Regulation is amended by striking out “he or she” and substituting “they”.

(2) The English version of clause 36 (4) (a) of the Regulation is amended by striking out “he or she” wherever it appears and substituting in each case “they”.

(3) The English version of clause 36 (4) (b) of the Regulation is amended by striking out “he or she has” and substituting “they have”.

18. The English version of the Regulation is amended by striking out “his or her” wherever it appears and substituting in each case “their”.

Commencement

19. This Regulation comes into force on the later of May 1, 2027 and the day this Regulation is filed.
