Amending O. Reg. 51/24

(EXEMPTIONS FROM THE ACT AND FROM PART II.1 OF THE ACT)

1. (1) Ontario Regulation 51/24 is amended by adding the following section:

Waste disposal sites, changes to fill rate or service area

5.1 (1) The following provisions of the Act do not apply with respect to a condition of an approval to proceed with a Part II.3 project given under Part II.3 of the Act, to the extent that the condition limits the fill rate or service area of a waste disposal site:

1. Subsection 17.2 (5).

2. Subsection 17.27 (6).

3. Section 38.

(2) In this section,

“fill rate” means the rate at which a landfilling site or dump is filled; (“taux de remplissage”)

“landfilling site” and “dump” have the same meaning as in of Ontario Regulation 50/24 (Part II.3 Projects — Designations and Exemptions). (“lieu d’enfouissement”, “décharge”)

(2) The definition of “landfilling site” and “dump” in subsection 5.1 (2) of the Regulation, as made by subsection (1), is amended by striking out “Part II.3 Projects — Designations and Exemptions” and substituting “Designation of Part II.3 and Part II.4 Projects”.

Commencement

2. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.

(2) Subsection 1 (2) comes into force on January 1, 2027.
