Amending O. Reg. 73/94

(GENERAL)

1. (1) Ontario Regulation 73/94 is amended by adding the following section:

15.1 (1) The requirements of Part II of the Environmental Bill of Rights, 1993 do not apply to a proposal to amend an environmental compliance approval under Part II.1 of the Environmental Protection Act in respect of an activity mentioned in subsection 27 (1) of that Act if the proposed amendment relates solely to the fill rate or service area of a waste disposal site.

(2) In this section,

“fill rate” means the rate at which a landfilling site or dump is filled; (“taux de remplissage”)

“landfilling site” and “dump” have the same meaning as in of Ontario Regulation 50/24 (Part II.3 Projects - Designations and Exemptions). (“lieu d’enfouissement”, “décharge”)

(2) The definition of “landfilling site” and “dump” in subsection 15.1 (2) of the Regulation, as made by subsection (1), is amended by striking out “Part II.3 Projects - Designations and Exemptions” and substituting “Designation of Part II.3 and Part II.4 Projects”.

Commencement

2. (1) Except as otherwise provided in this section, this Regulation comes into force on the day it is filed.

(2) Subsection 1 (2) comes into force on the later of January 1, 2027 and the day this Regulation is filed.
