Non-application of Act

1. (1) No provision of the Act applies with respect to construction work in Ontario under a construction contract that was in force before the date Ontario Regulation 49/02 comes into force.

(2) Subsection (1) does not apply with respect to a new contract with respect to a construction contract referred to in that subsection or work arranged with respect to a construction contract referred to in that subsection if the new contract is made or the work arranged on or after the date Ontario Regulation 49/02 comes into force.
