dissolution of and assumption of powers of local boards

Dissolution of local board

1. (1) If the City passes a by-law to dissolve a local board,

(a) the City stands in the place of the board for all purposes, on and after the effective date;

(b) the board’s powers vest in the City on the effective date;

(c) all rights, claims, undertakings, obligations, assets and liabilities of the board vest in the City on the effective date;

(d) the by-laws and resolutions of the board,

(i) are continued as by-laws and resolutions of the City, on the effective date, and

(ii) remain in force until repealed or amended;

(e) the board ceases to exist on the effective date; and

(f) if the board is a corporation, it is dissolved on the effective date.

(2) The effective date for the purposes of subsection (1) is the day the by-law comes into force.

(3) If the City passes a by-law to dissolve a local board of the City and one or more other municipalities, each municipality stands in the place of the board for the purposes of that municipality on the day the by-law comes into force, and subsection (1) applies with necessary modifications.

Assumption of powers from local board

2. (1) If the City passes a by-law to assume one or more powers from a local board,

(a) the City stands in the board’s place for the purpose of exercising the assumed powers, on and after the effective date;

(b) the assumed powers vest in the City on the effective date;

(c) all rights, claims, undertakings and obligations, assets and liabilities of the board pertaining to the assumed powers vest in the City on the effective date; and

(d) the board’s by-laws and resolutions pertaining to the exercise of the assumed powers,

(i) are continued as by-laws and resolutions of the City, on the effective date, and

(ii) remain in force until repealed or amended.

(2) The effective date for the purposes of subsection (1) is the day the by-law comes into force.

(3) If the City passes a by-law to assume one or more powers from a local board of the City and one or more other municipalities, each municipality stands in the place of the board for the purpose of exercising the assumed powers on the day the by-law comes into force, and subsection (1) applies with necessary modifications.

Toronto Atmospheric Fund, etc.

3. For the purposes of this Regulation, the Toronto Atmospheric Fund and the Toronto Atmospheric Fund Foundation are local boards of the City.

Commencement

4. This Regulation comes into force on the later of the day it is filed and the day section 153 of the City of Toronto Act, 2006 comes into force.
