Amending O. Reg. 60/08

(Lake Simcoe Protection)

1. (1) Subsection 2 (1) of Ontario Regulation 60/08 is revoked and the following substituted:

(1) Each owner of a sewage treatment plant listed in Column 2 of Table 1 shall ensure that the plant does not discharge in treated sewage to a surface water body an amount of total phosphorus that exceeds the amount listed opposite each plant in Column 4 of Table 1 during each of the following periods:

1. April 1, 2008 to March 31, 2009.

2. April 1, 2009 to March 31, 2010.

(2) Subsection 2 (2) of the Regulation is amended by striking out “the period” in the portion before clause (a) and substituting “a period”.

2. Section 3 of the Regulation is revoked.

3. (1) Subsection 4 (1) of the Regulation is revoked and the following substituted:

(1) Each owner of a sewage treatment plant listed in Column 2 of Table 1 shall calculate the average amount of total phosphorus discharged from the plant for each month during each of the following periods:

1. April 1, 2008 to March 31, 2009.

2. April 1, 2009 to March 31, 2010.

(2) Subsection 4 (2) of the Regulation is revoked and the following substituted:

(2) In calculating the average amount of total phosphorus under subsection (1), the owner shall, in a manner specified by the Director appointed in respect of subsection 53 (3) of the Act, base the calculation on the sampling and testing results obtained in accordance with the approval issued for the sewage treatment plant under section 53 of the Act.

4. (1) Subsection 5 (1) of the Regulation is revoked and the following substituted:

Final report

(1) Each owner of a sewage treatment plant listed in Column 2 of Table 1 shall submit a report to the Director appointed in respect of subsection 53 (3) of the Act,

(a) on or before June 30, 2009, setting out the information mentioned in subsection (1.1) with respect to the period from April 1, 2008 to March 31, 2009; and

(b) on or before June 30, 2010, setting out the information mentioned in subsection (1.1) with respect to the period from April 1, 2009 to March 31, 2010.

(1.1) A report mentioned in subsection (1) shall set out, with respect to the period,

(a) the amount of total phosphorus discharged from the plant during each month; and

(b) the total amount of total phosphorus discharged from the plant.

(2) Subsection 5 (2) of the Regulation is amended by striking out “The report” and substituting “A report”.

5. Section 9 of the Regulation is revoked and the following substituted:

Revocation of provisions of this Regulation

9. Sections 6 and 7 are revoked on the day that the Lake Simcoe Protection Plan, established under the Lake Simcoe Protection Act, 2008, takes effect, which day is specified in the Plan and notice of which is published on the environmental registry established under section 5 of the Environmental Bill of Rights, 1993.

6. Table 1 of the Regulation is amended by striking out “from April 1, 2008 to March 31, 2009” in the title to Column 4 and substituting “from April 1, 2008 to March 31, 2009 and from April 1, 2009 to March 31, 2010”.

7. This Regulation comes into force on the later of April 1, 2009 and the day this Regulation is filed.
