Amending O. Reg. 134/98

(General)

1. Clauses 38 (1) (a) to (d) of Ontario Regulation 134/98 are revoked and the following substituted:

(a) if the applicant or recipient is a single person, $585;

(b) if the applicant or recipient has a spouse included in the benefit unit and there are no other dependants, $1,010;

(c) if the applicant or recipient has a spouse included in the benefit unit and there are one or more other dependants, $1,694 for the applicant or recipient, the spouse and one other dependant plus $500 for each additional dependant;

(d) if the applicant or recipient has no spouse included in the benefit unit and there are one or more dependants, $1,619 for the applicant or recipient and one dependant plus $500 for each additional dependant; and

2. (1) The Table to paragraph 1 of subsection 41 (1) of the Regulation is revoked and the following substituted:

For each additional dependant:
add $153 if the dependant is 18 years of age or older,
or $0 if the dependant is 0-17 years of age.

(2) The Table to paragraph 2 of subsection 41 (1) of the Regulation is revoked and the following substituted:

4. Subsection 43 (1) of the Regulation is amended by striking out “$125” and substituting “$128”.

add $88 if the dependant is 18 years of age or older
add $51 if the dependant is 0 - 17 years of age

(2) The Table to paragraph 2 of subsection 44 (1) of the Regulation is revoked and the following substituted:

For each additional dependant, add $40.

(3) Paragraph 4 of subsection 44 (1) of the Regulation is amended by striking out “$34” at the end and substituting “$35”.

(4) Paragraph 5 of subsection 44 (1) of the Regulation is amended by striking out “$58” at the beginning and substituting “$60”.

(5) Paragraphs 1 to 4 of subsection 44 (2) of the Regulation are revoked and the following substituted:

1. $228 for the first dependant of the dependant.

2. $97 for the second dependant of the dependant.

3. $115 for each subsequent dependant of the dependant.

4. If the applicant or recipient resides north of the 50th parallel and is without year-round road access, an additional amount equal to the sum of $91 for the first dependant of the dependant and $40 for any subsequent dependant of the dependant.

(6) The Table to paragraph 1 of subsection 44 (3) of the Regulation is revoked and the following substituted:

(7) The Table to paragraph 2 of subsection 44 (3) of the Regulation is revoked and the following substituted:

(8) Paragraph 4 of subsection 44 (3) of the Regulation is amended by striking out “$58” at the beginning and substituting “$60”.

6. (1) Clauses 44.1 (2) (a) to (d) of the Regulation are revoked and the following substituted:

(a) not less than the sum of $125 for each member of the benefit unit, with respect to determinations relating to a month after November 30, 2008 and before December 1, 2009; and

(b) not less than the sum of $128 for each member of the benefit unit, with respect to determinations relating to a month after November 30, 2009.

(2) Subsection 44.1 (3) of the Regulation is amended by striking out “$125” and substituting “$128”.

7. The Table to subparagraph 1 ii of section 51 of the Regulation is revoked and the following substituted:

For each additional dependant:
add $153 if the dependant is 18 years of age or older,
or $0 if the dependant is 0-17 years of age.
The amount attributable to a dependent child shall be reduced by 50 per cent where budgetary requirements for the child were reduced under section 44.2.

8. Paragraph 5 of subsection 55 (1) of the Regulation is amended by striking out “$70” and substituting “$72”.

9. Clauses 57 (5) (a) and (b) of the Regulation are revoked and the following substituted:

(a) $304 for the first child and $248 for each additional child if the adult applicant or recipient resides north of the 50th parallel and is without year round road access;

(b) $241 for the first child and $196 for each additional child if clause (a) does not apply;

10. Section 58.2 of the Regulation is revoked.

11. This Regulation comes into force on December 1, 2009.
