Amending O. Reg. 339/94

(Demerit Point System)

1. (1) The Table to Ontario Regulation 339/94 is amended by adding the following item:

 

33.2

Clause 106 (4) (b) of the Highway Traffic Act

Driving while child passenger not properly secured

(2) Items 35 and 36 of the Table to the Regulation are revoked and the following substituted:

 

35	Clause 159 (1) (a) of the Highway Traffic Act	3	Failing to stop on right for emergency vehicle
36	Clause 159 (1) (b) of the Highway Traffic Act	3	Failing to stop – nearest curb – for emergency vehicle
36.1	Clause 159 (1) (b) of the Highway Traffic Act	3	Failing to stop – nearest edge of roadway – for emergency vehicle
36.2	Subsection 159 (2) of the Highway Traffic Act	3	Failing to slow down and proceed with caution for emergency vehicle
36.3	Subsection 159 (3) of the Highway Traffic Act	3	Failing to move into another lane for emergency vehicle – if safe to so
36.4	Subsection 159 (4) of the Highway Traffic Act	3	Following fire department vehicle too closely

2. (1) Subject to subsections (2) and (3), this Regulation comes into force on the day it is filed.

(2) Subsection 1 (1) comes into force on the later of January 1, 2010 and the day this Regulation is filed.

(3) Subsection 1 (2) comes into force on the later of the day section 49 of the Road Safety Act, 2009 comes into force and the day this Regulation is filed.
