Amending O. Reg. 31/05

1. Sections 11 and 11.1 of Ontario Regulation 31/05 are revoked and the following substituted:

Expiry of licences

11. (1) A licence issued or renewed under this Regulation expires on the date set out in the licence, which shall be the third March 31 after the licence was issued or renewed.

(2) Despite subsection (1), the expiry date set out in a licence may be any date that is earlier than the date required by that subsection if the director issuing or renewing the licence is of the opinion that the past conduct of the applicant or licensee or, if the applicant or licensee is a corporation, of an officer, director or employee of the applicant or licensee, is such that it would be in the public interest to renew the licence at more frequent intervals.

(3) A licensee must apply for renewal of a licence not later than 60 days before its expiry date in order for the licence to be deemed to continue under subsection 6 (6) of the Act.

Expiry of licences — phased-in period

11.1 (1) Despite subsection 11 (1),

(a) a licence held by a Group 1 plant that is renewed in 2011 expires on the date set out in the licence, which shall be March 31, 2012; and

(b) a licence held by a Group 2 plant that is renewed in 2011 expires on the date set out in the licence, which shall be March 31, 2013.

(2) Subsections 11 (2) and (3) apply with necessary modifications to a licence described in clause (1) (a) or (b).

(3) For the purposes of this section,

“Group 1 plant” means  a plant, identified by its plant number as set out in its licence, that is listed in Part I of Schedule 1;

“Group 2 plant”  means a plant identified by its plant number as set out in its licence, that is listed in Part II of Schedule 1.

(4) This section is revoked on April 1, 2013.

2. (1) The Regulation is amended by adding the following Schedule:

(2) Schedule 1 to the Regulation is revoked.

3. (1) Subject to subsection (2), this Regulation comes into force on the later of January 1, 2011 and the day this Regulation is filed.

(2) Subsection 2 (2) comes into force on April 1, 2013.
