Amending O. Reg. 114/99

(Family Law Rules)

1. (1) Rule 7 of Ontario Regulation 114/99 is amended by adding the following subrule:

Motion to Change order under s. 57.1 of the child and family services act

(4.1) In a motion to change an order made under section 57.1 of the Child and Family Services Act, the children’s aid society that was a party to the case in which the order was made is not a party to the motion to change the order, unless the court orders otherwise.

(2) Paragraph 5 of subrule 7 (6) of the Regulation is revoked and the following substituted:

5. In a motion to change an order made under section 57.1 of the Child and Family Services Act,

i. the person making the motion shall be named as the applicant and every other party to the motion shall be named as the respondents, and

ii. the motion shall be given a new court file number.

2. Subrule 42 (19) of the Regulation is amended by striking out “June 30, 2012” at the end and substituting “July 1, 2014”.

3. The Table of Forms to the Regulation is amended by striking out,

Commencement

4. This Regulation comes into force on the day it is filed.
