TRAINING REQUIREMENTS FOR CERTAIN COMPULSORY TRADES

Definitions

1. In this Regulation,

“certificate of qualification” has the same meaning as in the Ontario College of Trades and Apprenticeship Act, 2009; (“certificat de qualification”)

“construction sector compulsory trade” means a trade that is prescribed as a compulsory trade for that sector under the Ontario College of Trades and Apprenticeship Act, 2009 and that is listed in Schedule 1; (“métier à accréditation obligatoire du secteur de la construction”)

“motive power sector compulsory trade” means a trade that is prescribed as a compulsory trade for that sector under the Ontario College of Trades and Apprenticeship Act, 2009 and that is listed in Schedule 2; (“métier à accréditation obligatoire du secteur de la force motrice”)

“registered training agreement” has the same meaning as in the Ontario College of Trades and Apprenticeship Act, 2009. (“contrat d’apprentissage enregistré”)

Construction sector compulsory trades

2. (1) No worker shall perform work in a construction sector compulsory trade unless the worker holds a certificate of qualification in that trade that is not suspended or unless the worker is an apprentice in that trade and is working pursuant to a registered training agreement that is not suspended.

(2) No employer shall employ a worker to perform work in a construction sector compulsory trade unless the worker holds a certificate of qualification in that trade that is not suspended or unless the worker is an apprentice in that trade and is working pursuant to a registered training agreement that is not suspended.

(3) Subsections (1) and (2) do not apply if section 2 of the Ontario College of Trades and Apprenticeship Act, 2009 does not apply to the worker when he or she performs the work.

Motive power sector compulsory trades

3. (1) No worker shall perform work in a motive power sector compulsory trade unless the worker holds a certificate of qualification in that trade that is not suspended or unless the worker is an apprentice in that trade and is working pursuant to a registered training agreement that is not suspended.

(2) No employer shall employ a worker to perform work in a motive power sector compulsory trade unless the worker holds a certificate of qualification in that trade that is not suspended or unless the worker is an apprentice in that trade and is working pursuant to a registered training agreement that is not suspended.

(3) Subsections (1) and (2) do not apply if section 2 of the Ontario College of Trades and Apprenticeship Act, 2009 does not apply to the worker when he or she performs the work.

Revocation

4. This Regulation is revoked.

Revocation

5. Ontario Regulation 572/99 is revoked.

Commencement

6. (1) Subject to subsections (2) and (3), this Regulation comes into force on the day it is filed.

(2) Sections 1, 2, 3 and 5 come into force on the later of the day section 103 of the Ontario College of Trades and Apprenticeship Act, 2009 comes into force and the day this Regulation is filed.

(3) Section 4 comes into force on the first anniversary of the day sections 1, 2, 3 and 5 of this Regulation come into force.
