Amending O. Reg. 79/10

(GENERAL)

1. (1) Subsection 247 (1) of Ontario Regulation 79/10 is amended by striking out “$36.34” at the end and substituting “$36.85”.

(2) Subsection 247 (2) of the Regulation is amended by striking out “$1,707.59” at the end and substituting “$1,731.62”.

(3) Subsection 247 (3) of the Regulation is amended by striking out “$56.14” at the end and substituting “$56.93”.

(4) Subsection 247 (4) of the Regulation is amended by striking out “$2,011.76” at the end and substituting “$2,066.21”.

(5) Subsection 247 (5) of the Regulation is amended by striking out “$66.14” at the end and substituting “$67.93”.

(6) Subsection 247 (6) of the Regulation is amended by striking out “$2,361.55” at the end and substituting “$2,438.81”.

(7) Subsection 247 (7) of the Regulation is amended by striking out “$77.64” at the end and substituting “$80.18”.

2. (1) Subsection 247.1 (2) of the Regulation is amended by striking out “$1,950.93” at the end and substituting “$1,974.96”.

(2) Subsection 247.1 (3) of the Regulation is amended by striking out “$64.14” at the end and substituting “$64.93”.

(3) Subsection 247.1 (4) of the Regulation is amended by striking out “$2,255.09” at the end and substituting “$2,279.12”.

(4) Subsection 247.1 (5) of the Regulation is amended by striking out “$74.14” at the end and substituting “$74.93”.

3. (1) Subparagraph 1 iii of subsection 247.2 (1) of the Regulation is amended by striking out “On or after July 1, 2012” at the beginning and substituting “On or after July 1, 2012 but before July 1, 2013”.

(2) Subsection 247.2 (2) of the Regulation is amended by striking out “$1,981.34” at the end and substituting “$2,005.37”.

(3) Subsection 247.2 (3) of the Regulation is amended by striking out “$65.14” at the end and substituting “$65.93”.

(4) Subsection 247.2 (4) of the Regulation is amended by striking out “$2,308.32” at the end and substituting “$2,332.35”.

(5) Subsection 247.2 (5) of the Regulation is amended by striking out “$75.89” at the end and substituting “$76.68”.

4. The Regulation is amended by adding the following section:

Exceptions — occupancy on or after September 1, 2014 in certain circumstances

247.3 (1) Subsections 247 (4) to (7) do not apply in any of the following circumstances:

1. Where, on or after September 1, 2014, a long-stay resident occupies a bed in a room for which a licensee provides semi-private accommodation or private accommodation and the following criteria are satisfied:

i. The class of bed is not set out in paragraph 1 of subsection 247.1 (1).

ii. The resident did not occupy the bed before July 1, 2013.

iii. On or after July 1, 2013 but before September 1, 2014, the resident occupied any bed that is not a class of bed set out in paragraph 1 of subsection 247.1 (1) in a room for which the licensee provided the same type of accommodation.

2. Where a licensee provided a long-stay resident with semi-private accommodation or private accommodation described in paragraph 1 and, on or after September 1, 2014, the resident occupies a bed in a room for which a licensee provides the resident with semi-private accommodation or private accommodation in any of the following:

i. A related temporary long-term care home.

ii. A re-opened long-term care home.

iii. A replacement long-term care home.

iv. A long-term care home under section 208.

3. Where a long-stay resident in a long-term care home was an applicant in the re-admission category on the waiting list for the long-term care home in accordance with section 177 or the specialized unit in accordance with subsection 202 (2) and a licensee provided the resident with semi-private accommodation or private accommodation in either of the circumstances described in paragraphs 1 and 2 immediately before the resident was discharged from the long-term care home or specialized unit, as the case may be.

(2) The maximum monthly amount that may be charged by a licensee for providing a long-stay resident with semi-private accommodation for a full month in the circumstances described in subsection (1) is $2,035.79.

(3) The maximum daily amount that may be charged by a licensee for providing a long-stay resident with semi-private accommodation for less than a full month in the circumstances described in subsection (1) is $66.93.

(4) The maximum monthly amount that may be charged by a licensee for providing a long-stay resident with private accommodation for a full month in the circumstances described in subsection (1) is $2,385.58.

(5) The maximum daily amount that may be charged by a licensee for providing a long-stay resident with private accommodation for less than a full month in the circumstances described in subsection (1) is $78.43.

(6) A licensee shall not charge a long-stay resident to whom subsection (1) applied more than the amounts set out in this section if the resident is transferred to a semi-private room or private room and the resident did not request the transfer.

(7) A licensee shall not charge a long-stay resident to whom paragraph 2 of subsection (1) applied more than the amounts set out in this section if the room that the resident next occupies is a semi-private room or private room in a home described in that paragraph.

5. (1) Paragraph 1 of subsection 253 (7) of the Regulation is amended by striking out “subtract an allowance of $136” and substituting “subtract an allowance of the amount set out in paragraph 1 of subsection 32 (1) of Ontario Regulation 222/98 (General) made under the Ontario Disability Support Program Act, 1997”.

(2) Paragraph 1 of subsection 253 (10) of the Regulation is amended by striking out “$1,320.95” and substituting “$1,339.44”.

(3) Paragraph 2 of subsection 253 (10) of the Regulation is amended by striking out “$569.53” at the end and substituting “$577.50”.

Commencement

6. (1)  Subject to subsections (2) and (3), this Regulation comes into force on the day it is filed.

(2)  Sections 1 and 2, subsections 3 (2) to (5) and sections 4 and 5 come into force on September 1, 2014.

(3)  Subsection 3 (1) is deemed to have come into force on July 1, 2013.
