Amending Reg. 611 of R.R.O. 1990

(SAFETY INSPECTIONS)

1. Section 1 of Regulation 611 of the Revised Regulations of Ontario, 1990 is amended by adding the following definition:

“mobile equipment vehicle” has the same meaning as in Ontario Regulation 398/16 (Road-Building Machines) made under the Act; 

2. Schedule 3 to the Regulation is amended by adding the following section:

4. (1) This section applies to inspections of a mobile equipment vehicle governed by NSC Standard 11B.

(2) Following are the modifications to NSC Standard 11B:

1. In Section 3H – Hydraulic Brakes, the statement “Every truck or bus manufactured on or after April 1, 2000, with a GVW above 4,536 kg must be equipped with ABS” that appears as a Note in the left-hand column under item 17. Anti-Lock Brake System (ABS) on a Truck or Bus does not apply.

2. In Section 3A – Air Brakes, the statement “Every truck and truck-tractor with air brakes manufactured on or after April 1, 2000 must be equipped with ABS” that appears as a Note in the left-hand column under item 19. Anti-Lock Brake System (ABS) on Truck and Bus does not apply.

3. In Section 6 – Lamps,

i. items 1 e) and m), which set out requirements for centre high mount stop lamps and daytime running lamps, do not apply,

ii. the statements “lens designation is “F”” and “and only when the headlamp control is switched to low beam” that appear in the right-hand column under item 1 n) do not apply,

iii. CMVSS, DOT and SAE standards do not apply, other than those required by Areas 1 to 11 under the chart titled “Basic Equipment Required on All Trucks, Buses and MPVs” and Area 12 under the chart titled “Additional Equipment for Specific Vehicles”, and the accompanying diagrams,

iv. despite subparagraph iii, the following do not apply:

A. “Height from the Ground” requirements,

B. “SAE Lens Coding” requirements, and

C. the requirement that intermediate side marker lamps be located “near centre”.

4. In Section 8 – Body, items 13 f) and 14 c), which set out requirements for windows and windshields, do not apply if the vehicle’s windows and windshields bear an equivalent marking from a different jurisdiction.

Commencement

3. This Regulation comes into force on the later of the day section 7 of Schedule 12 to the Jobs for Today and Tomorrow Act (Budget Measures), 2016 comes into force and the day this Regulation is filed.
