Amending O. Reg. 248/03

(DRINKING WATER TESTING SERVICES)

1.  Subsection 1 (2) of Ontario Regulation 248/03 is amended by adding the following definition:

“trained person” has the same meaning as in Ontario Regulation 170/03 (Drinking Water Systems);

2. Sub-subparagraph 3 ii E of section 6 of the Regulation is amended by striking out “Ontario Regulation 243/07 (Schools, Private Schools and Day Nurseries)” and substituting “Ontario Regulation 243/07 (Schools, Private Schools and Child Care Centres) made under the Act”.

3. Clause 10 (1) (e) of the Regulation is revoked and the following substituted:

(e) retain the sample until the earlier of,

(i) the day the result of the drinking water test has been reported in accordance with section 12 or 12.0.1, or

(ii) the day the sample is permitted to be discarded in accordance with a condition in the person’s drinking water testing licence.

4. (1) Subsection 12 (2) of the Regulation is amended by striking out “28 days” in the portion before clause (a) and substituting “10 days”.

(2) Subsection 12 (3) of the Regulation is amended,

(a) by striking out “28 days” in the portion before paragraph 1 and substituting “10 days”;

(b) by striking out “by an approval or order” in paragraph 2 and substituting “by an approval, a municipal drinking water licence or an order”;

(c) by striking out “Ontario Regulation 243/07 (Schools, Private Schools and Day Nurseries) made under the Act” in paragraph 4 and substituting “Ontario Regulation 243/07 (Schools, Private Schools and Child Care Centres)”; and

(d) by adding the following paragraphs:

5. A test authorized by a drinking water testing licence if the test is for a pesticide not listed in Schedule 2 to Ontario Regulation 169/03 (Ontario Drinking Water Quality Standards) made under the Act and is conducted by or pursuant to the direction of any of the following:

i. The owner of a drinking water system.

ii. The operating authority for a drinking water system.

iii. A certified operator or trained person employed by the owner or operating authority.

6. Any other test authorized by a drinking water testing licence if the test is carried out after January 1, 2018 and is conducted by or pursuant to the direction of any of the following:

i. The owner of a drinking water system.

ii. The operating authority for a drinking water system.

iii. A certified operator or trained person employed by the owner or operating authority.

(3) Subsection 12 (3.1) of the Regulation is amended by striking out “28 days” and substituting “10 days”.

5. Clause 12.1 (1) (e) of the Regulation is amended by adding “and Climate Change” at the end.

6. Paragraph 4.1 of subsection 13 (1) of the Regulation is amended by striking out “Ontario Regulation 243/07 (Schools, Private Schools and Day Nurseries)” and substituting “Ontario Regulation 243/07 (Schools, Private Schools and Child Care Centres)”.

Commencement

7. This Regulation comes into force on the later of July 1, 2017 and the day it is filed.
