Amending O. Reg. 666/98

(POSSESSION, BUYING AND SELLING OF WILDLIFE)

1. Section 3.1 of Ontario Regulation 666/98 is amended by adding the following subsection:

(4.0.1) Despite subsection (4), if a person who holds a farmer’s licence to sell pelts and carcasses and who is trapping under subsection 6 (3) of the Act or a person who holds a trapping licence kills an otter during the closed season despite the exercise of all due diligence, the person may possess the pelt of the otter if:  

(a) the person incidentally kills the otter while lawfully trapping beaver during the open season for beaver; and

(b) the person records the incidentally killed otter on the season-end harvest report required under section 13 of Ontario Regulation 667/98 (Trapping) within 24 hours of the close of the relevant open season for beaver.

2. Part IX of the Regulation is revoked.

3. This Regulation comes into force on the later of April 1, 2017 and the day it is filed.
