Amending O. Reg. 570/05

(LICENSING OF ELECTRICAL CONTRACTORS AND MASTER ELECTRICIANS)

1. The definitions of “prior electrical contractor licence” and “prior master electrician licence” in subsection 1 (1) of Ontario Regulation 570/05 are revoked.

2. (1) Clause 8 (c) of the Regulation is revoked and the following substituted:

(c) has an address for service in Ontario;

(2) Clause 8 (f) of the Regulation is revoked and the following substituted:

(f) is not in default of filing a return with the Minister of Finance or the Canada Revenue Agency or of paying any tax, penalty or interest assessed under the Excise Tax Act (Canada), the Retail Sales Tax Act or the Corporations Tax Act, if applicable, for which payment arrangements have not been made; and

3. Sections 10 and 10.1 of the Regulation are revoked.

4. (1) Subsection 13 (1) of the Regulation is amended by striking out “and a provisional electrical contractor licence” in the portion before paragraph 1.

(2) Paragraph 1 of subsection 13 (1) of the Regulation is revoked.

(3) Paragraph 2 of subsection 13 (1) of the Regulation is revoked and the following substituted:

2. The legal name of the business and the name under which it operates.

(4) Subsection 13 (5) of the Regulation is revoked.

5. (1) Subsection 14 (1) of the Regulation is revoked and the following substituted:

Contractor failure to continue to meet requirements for licence

(1) The holder of an electrical contractor licence shall immediately cease to operate the electrical contracting business in respect of which the licence is issued if any of the requirements for obtaining the licence, as set out in section 8, or a restriction, limitation or condition of the licence that is imposed by a Director or specified in sections 17 to 24 ceases to be met during the currency of the licence.

(2) Subsection 14 (2) of the Regulation is amended by striking out “subsection 8 (2)” and substituting “clause 8 (b)”.

6. (1) Subsection 15 (1) of the Regulation is amended by striking out “or a provisional electrical contractor licence”.

(2) Subsection 15 (4) of the Regulation is amended by striking out “a provisional electrical contractor licence”.

(3) Subsection 15 (5) of the Regulation is amended by striking out “clauses 8 (b) to (f)” and substituting “clauses 8 (b) to (g)”.

(4) Subsection 15 (6) of the Regulation is revoked.

(5) The following provisions of section 15 of the Regulation are amended by striking out “the information referred to in subsection (2), (3) or (4)” wherever that expression appears and substituting in each case “the information or documents described in subsection (5) or (7)”:

1. Subsection (8).

2. Subsection (9).

(6) Subsection 15 (10) of the Regulation is amended by adding “within the 12-month period preceding the date of the application” at the end.

(7) Subsections 15 (12) and (13) of the Regulation are revoked.

7. Section 16 of the Regulation is amended by striking out “and a provisional electrical contractor licence” at the end.

8. Section 22 of the Regulation is amended by adding “including any change in the designated master electrician for the purpose of clause 8 (b)” after “renewal of licence application”.

9. Section 24 of the Regulation is amended by adding “using a form of delivery that provides proof of delivery” at the end.

10. Section 28 of the Regulation is amended by adding “including the fact of ceasing to act as a designated master electrician for an electrical contractor” after “renewal of licence application”.

11. Section 30 of the Regulation is revoked and the following substituted:

Return of licence

30. A master electrician shall return the master electrician licence to the Director within five business days of its suspension, revocation or expiry, using a form of delivery that provides proof of delivery.

12. Sections 31 and 32 of the Regulation are revoked.

Commencement

13. This Regulation comes into force on the later of January 1, 2018 and the day it is filed.
