Amending O. Reg. 123/17
(GENERAL)
1. Paragraphs 4, 5 and 6 of subsection 2 (1) of Ontario Regulation 123/17 are revoked and the following substituted:
4. An individual or a firm, within the meaning of the Chartered Professional Accountants of Ontario Act, 2017, who is authorized under that Act to practise as a Chartered Professional Accountant and who is acting within that authority in providing services to a condominium corporation.
2. Clause 4 (1) (c) of the Regulation is revoked and the following substituted:
(c) if the applicant is an individual, be accompanied by a criminal record and judicial matters check under the Police Record Checks Reform Act, 2015 for the applicant that is dated no earlier than six months before the date on which the application is submitted to the registrar;
3. Clause 9 (1) (b) of the Regulation is revoked and the following substituted:
(b) within the one-year period before the day section 34 of the Act comes into force, provided condominium management services to a client.
4. The Regulation is amended by adding the following section:
Exemption re employment, deemed limited licence
10.1 A deemed limited licensee is exempt from subsection 51 (3) of the Act.
5. Section 11 of the Regulation is amended by adding the following subsections:
(2.1) An applicant is exempt from the requirements set out in paragraphs 1, 3 and 4 of subsection (1) if the applicant was licensed as a general licensee under a licence that has expired within the two years before making the application.
(2.2) If an applicant was licensed as a general licensee under a licence that has expired within the two years before making the application, the registrar may exempt the applicant from paragraph 2 of subsection (1), and may impose conditions on the exemption.
6. Section 13 of the Regulation is revoked and the following substituted:
Exemption re employment
13. A general licensee who is employed by no more than three condominium corporations and who is not an independent contractor is exempt from subsection 51 (3) of the Act.
7. (1) Clause 14 (1) (b) of the Regulation is revoked and the following substituted:
(b) within the one-year period before the day section 34 of the Act comes into force, provided condominium management services to a client.
(2) Section 14 of the Regulation is amended by adding the following subsection:
(5) A deemed transitional general licensee is exempt from subsection 51 (3) of the Act.
8. The Regulation is amended by adding the following section:
Exemption re employment, transitional general licence
16.1 A transitional general licensee who is employed by no more than three condominium corporations and who is not an independent contractor is exempt from subsection 51 (3) of the Act.
Commencement
9. (1) Subject to subsection (2), this Regulation comes into force on the later of the day section 34 of Schedule 2 to the Protecting Condominium Owners Act, 2015 comes into force and the day this Regulation is filed.
(2) Section 2 comes into force on the later of the day subsection 8 (1) of the Police Record Checks Reform Act, 2015 comes into force and the day this Regulation is filed.
