Amending Reg. 27 of R.R.O. 1990

(GENERAL)

1. Section 1 of Regulation 27 of the Revised Regulations of Ontario, 1990 is amended by adding the following definition:

“election day” means the day set out in subsection 3 (1); (“jour du scrutin”)

2. Subsections 2 (2), (3), (4) and (5) of the Regulation are revoked and the following substituted:

(2) Sixteen members shall be elected to the Council under clause 3 (2) (a) of the Act, as follows:

1. For the Eastern Ontario electoral district, two members.

2. For the Central Ontario electoral district, two members.

3. For the Northern Ontario electoral district, one member.

4. For the Western Ontario electoral district, two members.

5. For the City of Toronto electoral district, four members.

6. For the Province of Ontario electoral district, five members.

(3) For the purposes of subsection (2), one of the members for the Province of Ontario electoral district must hold a licence as a Licensed Technologist OAA; the remaining 15 elected members must not.

3. Section 3 of the Regulation is amended by adding the following subsection:

(5) No person is eligible to hold office as a member of the Council for more than three terms in succession.

4. The English version of clause 4 (1) (b) of the Regulation is amended by striking out “the Electoral District” and substituting “the electoral district”.

5. (1) Subsections 6 (1) and (2) of the Regulation are revoked and the following substituted:

(1) The nomination of candidates for election to the Council must,

(a) be in the nomination form prescribed by the Registrar, which shall be delivered to each member in an electoral district in which an election is to be held on or before the first Monday in October in each election year;

(b) include indications of support by at least three members, each of whom has an address of record within the electoral district for which the nominated member is eligible for election;

(c) in the case of a candidate nominated for the Province of Ontario electoral district, include an indication of interest supported by three other members; and

(d) be delivered to, or received by, the Registrar on or before the fourth Monday in October in each election year.

(2) A candidate must indicate his or her consent on the nomination form.

(2) The English version of subsection 6 (3) of the Regulation is amended by striking out “one Electoral District” at the end and substituting “one electoral district”.

6. The English version of section 7 of the Regulation is amended by,

(a) striking out “an Electoral District” and substituting “an electoral district”; and

(b) striking out “the Electoral District” and substituting “the electoral district”.

7. (1) Subsection 8 (1) of the Regulation is revoked and the following substituted:

(1) Except in electoral districts where candidates have been certified as elected by acclamation, the Registrar shall, on or before the second Monday of November, deliver to every member qualified to vote in the election a ballot in the form prescribed by the Registrar together with voting instructions.

(2) Subsection 8 (2) of the Regulation is amended by striking out “the ballot, the accompanying envelope or envelopes and the voting instructions” and substituting “the ballot and the voting instructions”.

(3) The English version of clause 8 (3) (a) of the Regulation is amended by striking out “the Electoral District” and substituting “the electoral district”.

(4) Clause 8 (3) (b) of the Regulation is revoked and the following substituted:

(b) in the Province of Ontario electoral district.

(5) Subsection 8 (4) of the Regulation is revoked and the following substituted:

(4) Each ballot shall be marked by the member voting in accordance with the voting instructions, and delivered to the Registrar so that it is received on or before the election day.

8. (1) Subsection 10 (1) of the Regulation is amended by,

(a) striking out “opened” and substituting “reviewed”; and

(b) striking out “clerical”.

(2) Subsection 10 (2) of the Regulation is amended by,

(a) striking out “examine the ballots”; and

(b) striking out “a book or other record” and substituting “a record”.

(3) Subsection 10 (4) of the Regulation is amended by striking out “together with all of the ballots”.

9. Section 11 of the Regulation is amended by striking out “and the ballots”.

10. (1) Subsection 12 (1) of the Regulation is amended by striking out “shall destroy all ballots in an election” and substituting “shall cause the election returns to be destroyed”.

(2) Subsection 12 (2) of the Regulation is amended by striking out “$200” and substituting “$500”.

(3) Clause 12 (5) (c) of the Regulation is amended by striking out “and envelopes”.

11. Section 13 of the Regulation is amended by striking out “Where there is an interruption of mail service during an election” at the beginning and substituting “If the delivery of ballots during an election is interrupted”.

12. The English version of clause 15 (1) (e) of the Regulation is amended by striking out “the Electoral District” and substituting “the electoral district”.

Commencement

13. This Regulation comes into force on the later of January 1, 2018 and the day it is filed.
