(GRANTS FOR STUDENT NEEDS - LEGISLATIVE GRANTS FOR THE 2017-2018 SCHOOL BOARD FISCAL YEAR)

1. Subsection 15 (2) of Ontario Regulation 252/17 is amended by adding the following paragraph:

7.1 Rural and northern allocation.

2. The Regulation is amended by adding the following section:

Rural and northern allocation

34.1 (1) The rural and northern allocation for a board, other than the Toronto District School Board and the Toronto Catholic District School Board, is determined as follows:

ERE × $116.28 × (RDR + RDF) ÷ 2

in which,

“ERE” is the estimated rural enrolment of the board, as set out in Column 2 of the Table to this subsection,

“RDF” is the rural density factor of the board, as set out in Column 3 of the Table to this subsection, and

“RDR” is the rural density ratio of the board, as set out in Column 4 of the Table to this subsection.

3. Section 48 of the Regulation is amended by striking out “2016-2017” wherever it appears and substituting in each case “2014-2015”.

4. Subsection 50 (19) of the Regulation is revoked and the following substituted:

(19) The increasing capital planning capacity amount is the sum of the amounts specified for the board in Column 2 and Column 3 of the following Table:

5. Subsections 70 (3), (4) and (5) of the Regulation are revoked and the following substituted:

(3) If in the current fiscal year and in the fiscal year preceding the current fiscal year, the reports described in subsection 16 (2) and subsection 16 (2) of the 2016-2017 grant regulation indicate that the board failed to comply with section 2, 5 or 9 of Ontario Regulation 132/12 (Class Size) made under the Act, the administration and governance limit is determined as follows, despite subsection (2):

1. Take the amount determined under subsection (2).

2. Subtract the internal audits amount (part of the administration and governance allocation).

3. Multiply the amount determined under paragraph 2 by 0.99.

(4) If in the current fiscal year and in both of the two fiscal years preceding the current fiscal year, the reports described in subsection 16 (2), subsection 16 (2) of the 2016-2017 grant regulation and subsection 16 (2) of the 2015-2016 grant regulation indicate that the board failed to comply with section 2, 5 or 9 of Ontario Regulation 132/12 (Class Size) made under the Act, the administration and governance limit is determined as follows, despite subsection (2):

1. Take the amount determined under subsection (2).

2. Subtract the internal audits amount (part of the administration and governance allocation).

3. Multiply the amount determined under paragraph 2 by 0.97.

(5) If in the current fiscal year and in all of the three fiscal years preceding the current fiscal year, the reports described in subsection 16 (2), subsection 16 (2) of the 2016-2017 grant regulation, subsection 16 (2) of the 2015-2016 grant regulation and subsection 16 (2) of the 2014-2015 grant regulation indicate that the board failed to comply with section 2, 5 or 9 of Ontario Regulation 132/12 (Class Size) made under the Act, the administration and governance limit is determined as follows, despite subsection (2):

1. Take the amount determined under subsection (2).

2. Subtract the internal audits amount (part of the administration and governance allocation).

3. Multiply the amount determined under paragraph 2 by 0.95.

(5.1) The Minister may determine that subsection (3), (4) or (5), as the case may be, does not apply to a board if the Minister is satisfied that the class sizes of the board have come into compliance with the limits set out in sections 2, 5 and 9 of Ontario Regulation 132/12 (Class Size) made under the Act during the fiscal year.

Commencement

6. This Regulation comes into force on the day it is filed.
